CONSENT AGREEMENT <br />FOR THE TUCKER CHASE SUBDI'VI'SI'ON DEVELOPMENT~ <br />FOR CABARRUS COUNTY <br /> <br />This Consent Agreement is entered into as of this 26th day of July, by and <br />among Carolina Development of Charlotte, the owners ("Developer'~ of the <br />Pro.lect and Cabarrus County, a pohtical subd~ws~on of the State of North <br />Carohna, by and through its Cabarrus County Board of Commissioners. <br /> <br />RECTTALS: <br /> <br /> A. Developer is the owner of approximately 72.34 acres of real property <br />located in Cabarrus County, and has proposed the development of a subdivision <br />with 220 total units in the Tucker Chase Subdivision project (the "Project'S, to be <br />constructed in multiple phases. <br /> <br /> B. The Project is subject to the Adequate Fac~hties Provisions of the <br />(;:abarrus County Subdivision Requlat~ons, Section 66-81, and has been reviewed <br />by all public agencies which may potentially serve the pro,lect and its future <br />residents. <br /> <br /> C. Developer ~s wilhng to advance public services and facilities for the <br />Project and to agree to certain other considerations to address Cabarrus County <br />and advance these services and facilities. <br /> <br /> D. Cabarrus County, acting pursuant to its authority under G.S. 153A-330 <br />to 335, and the Subdivision Regulations, has made certain determinations with <br />respect to the proposed Project, and, in the exercise of its legislative d~scretion, <br />has elected to process the Project, resulting in the negotiation, consideration and <br />approval of th~s Consent Agreement after all necessary heanngs. <br /> <br /> CABARRUS COUNTY AND THE DEVELOPER HEREBY AGREE AS <br />FOLLOWS: <br /> <br />1. The Project <br /> <br />1.1 <br /> <br />Description of Project. The Tucker Chase Subdiwsion Project <br />covered by this Consent Agreement presently consists of 220 s~ngle <br />family lots and townhomes located on approximately 72.34 acres. <br />Any changes must be in accordance with the C~barrus County <br />Subdivision Regulations and Zoning Ordinance, and may not to <br />exceed 2.81 units per gross acre of th.e Property for the S~nqle <br />Family Detache~ and the Townhomes are allowed up to 8 units Der <br />acre providinq that the proposed use meets the definition of a <br />mixed use development per Chapter 2, Section 2-2 of the Cabarrus <br />County Zoninq Ordinance. Standard m~ximum density is 6 units per <br />acre. [Attachment] <br /> <br /> <br />
