Original Message ..... <br />From: Carl S Swaim [mailto:cswaim@duke-energy.com] <br />Sent: Friday, July 30, 2004 3:47 PM <br />Subject: New Source Review Rulemaking in NC <br /> <br />RE: New Source Review Rulemaking in NC <br /> <br />The New Source Review (NSR) federal regulations became effective on August 7, 1980, with <br />the goals of protecting human health and welfare, ensuring economic growth while also <br />protecting existing clean air environments, and protecting the air quality in areas with <br />pristine scenic, historic, and natural recreational value. NSR is a pre-construction <br />review program. It consists of the Prevention of Significant Deterioration (PSD) program <br />and <br />Non- <br />Attainment Area Review. Before a new facility is built, or prior to the expansion or <br />modification of an existing facility, the emissions of regulated NSR pollutants resulting <br />from the project must be analyzed to see if the project is subject to NSR. <br /> <br />Proposed amendments to this regulation have the potential to adversely effect existing <br />industry and future economic development in NC. We encourage businesses, governments, and <br />organizations to send letters of support for Option 2 of the proposed amendments. This <br />zssue will certainly attract a lot of attention, and there will be many with very vocal <br />viewpoints. It is important for business and industry to be very visible in this process <br />at the hearing and by sending letters to be included in the hearing record in support of <br />the federal version of the NSR rules. Implementation of the federal version will ensure <br />that North Carolina remains economically competitive with surrounding states who do plan <br />to adopt rules similar to the federal rules. <br /> <br />A sample letter is attached for groups to use as a template to submit comments to DENR on <br />the proposed NSR rulemaking. Comments should be submitted by September 10, and the letter <br />is already addressed to the correct contact at DENR. (See attached file: Comments to <br />NCDENR on Proposed NSR Rules3.doc) <br /> <br />Attached is a copy of some simple talking points around the upcoming rulemaking effort by <br />the NC Environmental Management Commission around New Source Review (NSR). These rules <br />can have a major impact on new facilities or existing facilities making significant <br />changes (expansions). Public hearings on these rules are scheduled in Charlotte on August <br />5, 2004 at 7:00 pm at the Charlotte-Mecklenburg Government Center, Room 267, 600 East 4th <br />Street, Charlotte and in Raleigh on August 12, 2004 at 7:00 pm at the Parker Lincoln <br />Building, Air Quality Training Room, 2728 Capital Boulevard, Raleigh.
