It is not the intention to repeal, but rather to re-enact and <br /> continue in force such existing provisions so that all rights and liabilities <br /> that have accrued there under are preserved and may be enforced. <br /> <br />Ail provisions of the Subdivision Ordinance, which are not re-enacted herein <br />are hereby repealed. Ail suits at law for inequity and/or all prosecutions <br />resulting from the violation of any subdivision ordinance heretofore in <br />effect, which are now pending in any of the courts of this state or of the <br />United States shall not be abated or abandoned by reason of the adoption of <br />this ordinance, but shall be prosecuted to their finality the same as if this <br />ordinance had not been adopted, and any and all violators of the existing <br />ordinance prosecutions for which have not yet been instituted may be <br />hereafter filed and prosecuted, and nothing in this ordinance shall be <br />construed as to abandon, abate, or dismiss any litigation or prosecution, now <br />pending and/or which may heretofore have been instituted or prosecuted. <br /> <br />Section 3. Bonds, Clerk to the Board <br /> <br />(Appendix A, Street Cross Sections, is on file in the Office of the County <br />Manager and included by reference as a part of the minutes.) <br /> <br />The Ordinance Amending the Cabarrus County Zoning Ordinance as adopted by the <br />Board is as follows: <br /> <br />Petition C04-04 (T) Ordinance No. 2004-14 <br /> <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br /> <br />A) CHAPTER SIX: GENERAL REQUIREMENTS/EXCEPTIONS AND MODIFICATIONS. <br /> <br />1) Renumber section 6-13 to section 6-14 <br />2) Add new section 6-13 as follows: <br /> <br />Developments in the General Commercial and Limited Commercial Zoning <br />Districts shall be required to provide sidewalks in the following locations: <br /> <br /> a) On one side of all public streets directly adjacent to the <br /> developed site; <br /> b) On both sides of all ~nterior public streets within the <br /> development; <br /> C) Within the development to link buildings with the following: <br /> <br /> i) Parking <br /> ii) Adjoining streets <br /> iii) Adjoining sidewalks <br /> iv) Adjoining developments or amenities where appropriate <br /> pedestrian connections should be reasonably accomplished <br /> <br />A waiver from the sidewalk requirements may be granted by the Zoning <br />Administrator where the installation would not be reasonably tied to an <br />existing or planned pedestrian network.
