WSD - July 26, 2004 <br /> <br />DRAFT <br /> <br />Page 467 <br /> <br /> The Board of Commissioners of Cabarrus County, as the governing board <br />of the Water and Sewer District of Cabarrus County, met in regular session at <br />the Governmental Center in Concord, North Carolina on Monday, July 26, 2004, <br />at 6:30 p.m. <br /> <br /> Present - Chairman= Robert M. Freeman <br /> Commissioner: Carolyn B. Carpenter <br /> Commissioners: Robert W. Carruth <br /> <br /> Absent - Vice Chairman: Richard D. Suggs <br /> Commissioner: Coy C. Privette <br /> <br /> At 6:30 p.m., Chairman Freeman was present via telephone from Northeast <br />Medical Center. Vice Chairman Suggs was i11, and Commissioner Privette was <br />in China. <br /> <br /> Also present were John D. Day, County Manager; Maril~rn D. Porter, <br />Attorney; and Frankie F. Bonds, Clerk to the Board. <br /> <br /> As authorized during the meeting of the Board of County C'ommissioners, <br />Commissioner Carruth served as Acting Chairman for the July 26~ meeting and <br />called the meeting to order at 8:03 p.m. <br /> <br />Approval or Correction of Minutes <br /> <br /> ~IPON MOTION of Commissioner Carpenter, seconded by Acting Chairman <br />Carruth and unanimously carried, the Board approved the minutes of June 15, <br />2004, as submitted. <br /> <br />Ratification of the Partial Settlement A~re-mA-ts in the Litigation Involv~-u <br />Craft Development LLC, Morrison Creek, LLC, the City of Concord, Cabar~,~ <br />County and the Water and Sewer District <br /> <br /> Marilyn Porter reported Craft Development, LLC and Morrison Creek, LLC <br />sued the County, the City of Concord and the District. She said the County <br />filed cross claims against the City of Concord. It was determined the County <br />and District have no financial obligation to the plaintiffs but were asked to <br />sign off on partial settlement agreements entered into by the plaintiffs and <br />the City of Concord.
