EXTRACT FROM MINUTES OF BOARD OF COMMISSIONERS OF <br /> THE COUNTY OF CABARRUS, NORTH CAROLINA <br /> <br /> The Board of Commissioners for the County of Cabarms, North Carolina (the "Board"), <br />met in regular session in the Commissioner's Meeting Room in the Cabarms County <br />Governmental Center in Concord, North Carolina at 6:30 p.m., on August 16, 2004, with Robert <br />M. Freeman, Chairman, presiding. The following Commissioners were: <br /> <br />PRESENT: <br /> <br />ABSENT: <br /> <br />ALSO PRESENT: <br /> <br /> The Clerk to the Board of Commissioners presented certified copies of resolutions that <br />had been received from The Cabarrus County Board of Education and The Kannapolis City <br />Schools Board of Education. <br /> <br />read: <br /> <br />Commissioner <br /> <br /> introduced the following order authorizing bonds which was <br /> <br />ORDER AUTHORIZING $94,900,000.00 <br /> SCHOOL BONDS <br /> <br /> WHEREAS, The Cabarms County Board of Education and The Kannapolis City Schools <br />Board of Education have submitted to the Board of Commissioners for the County of Cabarms, <br />North Carolina, resolutions passed by said boards of education showing that adequate school <br />facilities are not now available in their respective administrative units to comply with the <br />requirements of Section 2 of Article IX of the Constitution of North Carolina for the <br />maintenance of schools at least nine months in every year and that it is necessary, in order to <br />maintain and provide such school system as required by said Section 2 of Article IX of the <br />Constitution, to provide additional school facilities in said units by erecting additional school <br />buildings and other school plant facilities, replacing, remodeling, enlarging and reconstructing <br />existing school buildings and other school plant facilities and acquiring any necessary land, <br />rights-of-way, furnishings and equipment therefor, including computers, the estimated aggregate <br />cost of which is approximately $94,900,000.00; <br /> <br /> WHEREAS, said resolutions request said Board of Commissioners to take all necessary <br />steps, by the issuance of bonds or otherwise, in order that funds for such school facilities may be <br />provided; and <br /> <br /> WHEREAS, said Board of Commissioners has carefully examined the facts and has <br />determined and does hereby find as a fact that the statements made in said resolutions are tree <br /> <br /> <br />
