<br />A RESOLUTION AUTHORIZING CONDEMNATION TO ACQUIRE <br />CERTAIN PROPERTY OF JOHNNY'S, LLC <br /> <br />WHEREAS, the Cabarrus County Board of Education and the Cabarrus County <br />Board of Commissioners (the "Boards") hereby detennine that it is both necessary and in <br />the public interest to acquire certain property which may be owned by Johnny's, LLC, for <br />the following purpose: <br /> <br />To expand and enhance the facilities available for the children of Cabarrus County, <br />including access to those facilities; and, more specifically, for improving access to Harris <br />Road Middle School for the safety both of,the students and the general public. <br /> <br />WHEREAS, the proper officials or representatives of the Boards have been unable to <br />acquire the needed interest in this property by negotiated conveyance. <br /> <br />, ) <br />NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY <br />BOARD OF EDUCATION and the CABARRUS COUNTY BOARD OF <br />COj\l[M[SSIONERS that: . <br /> <br />1. The Boards shall acquire by condenmation, for the purposes stated above, the <br />property and interest described in the attached Right-of-Way Plat (the "Property") which, <br />arguably, may be located in or under Harris Road, Cabarrus County, NC. . <br /> <br />2.
