<br />September 20, 2004 <br /> <br />DRAFT <br /> <br />Page <br /> <br />UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board scheduled a public hearing for <br />the October meeting to consider amendments to the Zoning Ordinance to make <br />mobile home parks and multifamily developments subject to the Adequate Public <br />Facilities Ordinance. <br /> <br />Chairman Freeman expressed appreciation to Commissioner Carruth for his <br />presentation. He reaffirmed his support of the bond referendum, stating he <br />had said at the August meeting that "we should support this bond," Also, he <br />expressed concern that some school personnel were "downing" the bonds. <br /> <br />Chairman Freeman made a motion to adopt the Resolution to Create a <br />Policy for the Advancement of School" Adequacy with the advancement value of <br />$4,034.00 and the development of a grant program for low-income and senior <br />citizens. Commissioner Privette seconded the motion. <br /> <br />Commissioner Carruth asked that the Resolution be amended to include a <br />.provision that the capital cost and required value of contribution would be <br />indexed annually to reflect the change in cost of school construction. <br />Chairman Freeman accepted the amendment. <br /> <br />Vice Chairman Suggs stated opposition to the proposed $4,034.00 per <br />lot, stating it would be detrimental to the building industry and associated <br />building trades. He questioned the legality of thæ adequacy requirement and <br />cautioned of potential lawsuits, <br /> <br />Jonathan Marshall, Commerce Director, explained <br />subdivisions for school adequacy and also addressed the <br />rights. <br /> <br />the review of <br />issue of vested <br /> <br />UPON MOTION of Chairman Freeman, seconded by Commissioner Privette with <br />Chairman Freeman, Commissioners Carruth, Carpenter and Privette voting for <br />and vice Chairman Suggs voting. against, the Board adopted the following <br />Resolution to Create a Policy for the Advancement of School Adequacy with the <br />capital cost and required value of contribution to be indexed annually. <br />Further, a grant progr~m is to be developed to make available a grant equal <br />to 100 percent of the value of adequacy advancement to those who qualify for <br />assistance from Habitat for Humanity, Prosperity Unlimited (formerly Cabarrus <br />Community Development Corporation) or any other HUe-approved community <br />housing organization and to the elderly who qualify for Homestead Exemption. <br /> <br />Resolution No. 2004-37 <br /> <br />Resolution to Create a Policy for the <br />Advancement of School Adequacy <br /> <br />WHEREAS, the Cabarrus County Board of Commissioners have put children first <br />through the funding of construction of rline elementary schools, four middle <br />schools, one high school and numerous additions and improvements to existing <br />schools over the last fifteen years; and <br /> <br />WHEREAS, the development and homebuilding industries are an important part of <br />the local economy; and <br /> <br />WHEREAS, a study by Tischler and Associates for Cabarrus County in 1996 found <br />that the direct school capital cost incurred by the County is $8067 per unit <br />for houses in transitional areas; and <br /> <br />WHEREAS, new homes constructed in these developments will be subject <br />property taxes which in part will offset the incurred capital cost; and <br /> <br />WHEREAS, new development continues to be approved within the unincorporated <br />areas of Cabarrus County after a review of the adequacy of services based on <br />the Cabarrus County Subdivision Regulations Chapter 4, Section 17 "Adequate <br />Public Facilities Standards"; and <br /> <br />WHEREAS, the Board of Commissioners is interested in approving <br />development that participates in the advancement of school adequacy; and <br /> <br />WHEREAS, the Board of Commissioners would like for all new residential <br />development in both the incorporated and unincorporated areas of Cabarrus <br />County to be reviewed for school adequacy. <br /> <br />NOW THEREFORE BE IT RESOLVED. by the Board of Commissioners of Cabarrus <br />County that shall adopt the following policy to address school adequacy when <br />reviewing new residential development: <br /> <br />A"~ <br /> <br />623 <br /> <br />.1 <br /> <br />to <br /> <br />new <br />
