<br />Grant of Right of Way to the
<br />City of Concord, N.C.
<br />
<br />The undersigned Grantor(s), in consideration of payment to the Grantor(s) of the sum of One
<br />Dollar, ($1.00), the receipt and sufficiency of which is hereby acknowledged, does (do) hereby grant,
<br />bargain, sell and release unto the City of Concord, N.C. ("Grantee"), its successors, assigns and licenses,
<br />the right, privilege and easement to enter and re-enter at any time and to install, dig, build, erect,
<br />maintain, repair, rebuild, operate, and patrol one or more electric power transmission lines, and/or other
<br />public utilities, over ground or underground, and one or more telephone, cable television, fiber optic or
<br />communications line(s) over ground or underground, including but not limited to, the right to erect poles
<br />and other transmission line structures,. wires, cables, pipes, and any necessary appurtenances for the
<br />proper conduct of electricity, electronic information, data, communications, water, sewer and any other
<br />public utilities; the right to clear the right of way and keep it clear of brushes, trees, buildings, obstructions,
<br />and fire hazards; and the right to remove trees, if any, located beyond the limits of the right of way, but
<br />which interfere with the right of way; the above described rights being incident to performance by the
<br />Grantee of its functions as a municipality or as the operator of any public utilities system, or the
<br />performance by any licensee of the Grantee of any public utilities functions, the premises to be affected
<br />hereby being as follows:

<br />DESCRIPTION OF RIGHT OF WAY
<br />
<br />Lying and being in the City of Concord, Cabarrus County, N.C., and lying on the south side of Cabarrus
<br />Avenue W. Being more particularly described as follows:
<br />
<br />COMMENCING at N.C.G.S Station "COUNTY", having grid coordinates of N = 602,914.271, E =
<br />1,521,149.485; thence N 63°59'32°E - 394.81' to a point on the right of way of Cabarrus Avenue, the
<br />POINT OF BEGINNING; thence with said right of way, N80o48'54"E - 20.69' to a point, the right of way
<br />intersection of Cabarrus Avenue and Health Department Drive; thence with the right of way of Health
<br />Department Drive, S26°09'44"E - 15.46' to a point; thence S08°56'53"E. 15.67' to a point; thence leaving
<br />said right of way, S80o32'56'W - 25.00' to a point; thence N09°27'O4'W - 30.56' to a point, the POINT OF
<br />BEGINNING.
<br />. Containing 732.93 square feet or 0.02 acres, more or less.
<br />
<br />. Together with any and all rights normally incident thereto, and particularly the right of ingress and
<br />egress thereto from time to time as necessary for construction, reconstruction, enlargement and/or
<br />maintenance.
<br />To have and to hold the same unto the City of Concord, N.C., its SUCcessors and assigns forever.
<br />
<br />This agreement shall not be Interpreted to Impose any duty on the City of Concord, Its
<br />successors and assigns to Install any utilities by any particular date or within any particular time
<br />frame.
<br />
<br />The Grantor(s) shall have the right to use the above-described strip for purposes not inconsistent
<br />with G~ntee's full enjoyment of the rights hereby granted, provided that the Grantor(s) shall not erect or
<br />construct any building or other structure thereon; maintain or permit any underground or over ground
<br />system of piping, poles or wiring within such strip; make any use of the facilities installed, buried, erected,
<br />or constructed thereon; or drill or operate any well or septic system within such strip, without the express
<br />written permission of the Grantee.
