<br />LEASE OF THE CABARRUS ARENA & EVENTS CENTER <br /> <br />THIS LEASE AGREEMENT, made and entered into effective the 1st day of September 2004, <br />by and between CABARRUS COUNTY, NORTH CAROLINA a political subdivision of the <br />State of North Carolina having its principal place of business at 65 Church Street, Concord, <br />North Carolina 28025 (the "Lessor") and TD SPORTS HOOPS, LLC, a North Carolina limited <br />liability company/corporation with its principle place of business at 800 Briar Creek Road, Suite <br />EE-200, Charlotte, North Carolina 28605(hereinafter referred to as "Lessee"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Lessee desires to lease and Lessor agrees to furnish, upon the tenDS and conditions <br />herein and for the purposes hereinafter named, certain space in the Cabarrus County Arena and <br />Events Center, located at 4751 NC Hwy. 49, Concord, North Carolina 28025 (the ~¡'ICenter") <br />commencing the 18th day of November 2004 and tenninating the 3rd day of March 2005 for the <br />use of the ABA basketball team, The Carolina Thunder (the "Team") which Lessee warrants and <br />represents to Lessor is owned solely and exclusively by the Lessee; and <br /> <br />WHEREAS, the Lessor is willing to lease to Lessee certain space in the Center upon the terms <br />and conditions set forth herein; <br /> <br />NOW THEREFORE, in consideration of the premIses and other good and valuable <br />consideration, the parties agree as follows: <br /> <br />1. DESCRIPTION OF LEASED SPACE: The Lessee shall lease from the Lessor that certain <br />space in the Center commonly referred to as the Arena and which space is depicted oIÍ the <br />drawing attached hereto ,as Exhibit 1 (hereafter, the "Leased Premises".) . <br /> <br />2. TERM/USE/PURPOSE: The initial tenD of this lease shall be from November 18, 2004 <br />through March 3,2005. Lessee shall use the Leased Premises for the sole and exclusive purpose <br />of providing a venue for the Team games during the 2004-2005 ABA Season (hereafter, the <br />"Event(s)".) Any other use ofthe Leased Premises or any other part of the Arena property must <br />be approved in advance by Arena management and will be subject to additional charges. <br /> <br />3. USE DATES: The Events shall occur on the following dates: <br />November 18, 2004 January 3,2005 January 29,2004 <br />November 23, 2004 January 4, 2005 February 26,2005 <br />November 26,2004 January 21,2005 February 27,2005 <br />November 27,2004 January 22,2005 March 1,2005 <br />December 15,2004 January 27,2005 March 2,2005 <br />December 23,2004 January 28,2005 March 3,2005 <br /> <br />f-3 <br />
