<br />PLANNING STAFF REPORT <br />TO CABARRUS COUNTY BOARD OF COMMISSIONERS <br />Monday December 20th, 2004 <br /> <br />Stafr-Use Only;ApJll'oved: <br /> <br />Denied; <br />Tabled: <br /> <br />Petition: C2004-08 (ZT) <br /> <br />Purpose: During a recent site plan review it was discovered that although attached townhomes are <br />permitted based on standards (PBS) in the AgiO, CR, HDR, MDR, LDR and OILC districts, they are <br />actually prohibited by setbacks unless the customized development option is used, i.e. there is still a <br />required side setback and minimum lot width. The customized development option is not applicable in <br />the OILC district. C2004-08 (ZT) seeks to correct this discrepancy by eliminating the side setback <br />requirement and changing the minimum lot width to flexible for townhomes in OILC district. Staff feels <br />it appropriate to retain the customized development requirement in other districts to improve aesthetics, <br />preserve rural character and provide for adequate open space in less dense districts. Petition C2004-08 <br />(ZT) seeks to effect these desired amendments. Approval of this amendment will effect the following <br />changes: <br /> <br />1. Amend the Cabanus County Zoning Ordinance "Chapter 5 Dimensional Requirements-PART ill, . <br />TABLE ONE: DEVELOPMENT SfANDARDS BY ZONING DISI'RICf" number 6 to add the <br />following notes: <br /> <br />Note 3) The setbacks for Townhouse development in the O/LC zoning district are as listed <br />above with the following exceptions. <br /> <br />Setbacks: <br />PRINCIPAL: <br />-Side ... Flexible <br />-Rear ... 30' <br /> <br />Minimum average lot width (townhome development):j1exible <br />Minimum average lot width (all other uses):50' . <br /> <br />2. Amend the Cabanus County Zoning Ordinance "Chapter 7 Performance Based Standards", <br />#43 Part a) Development Standards to read the following: <br /> <br />43. Townhouses <br /> <br />Zones permitting based on standards: <br />Agricultural/ open. countryside residential, . low density residential, medium density residential, <br />high density residential/ mixed use, office/limited commercial <br /> <br />Standards: <br /> <br />a) Development standards. In the AgriculturaVOpen, Countryside Residential, High Density <br />Residential, Medium Density Residential and Low Density Residential zones, townhouses may <br />be pennitted if their design is generated through the Customized Development Standards (See <br />Chapter Five). <br /> <br />Considerations: <br /> <br />Enactment of the proposed amendments will correct the discrepancy and allow townhomes <br />to be constructed in the OILC district as well as continuing to allow them to be constructed <br />as a customized development in the AgiO, CR, HDR,MDR, and LDR districts. <br /> <br />Staff Recommendation: <br /> <br />Page I of2 <br />Petition C2004-0S (ZT) <br /> <br />i <br />....., <br /> <br />r;~~ <br />
