CONSENT AGREEMENT <br />FOR ~HE MOORECREST DEVELOPMENT, <br />FOR CABARRUS COUNTY <br /> <br />This Consent Agreement ~s entered into as of th~s 27th day of .lanuarv, by <br />and among Dockside Development, the owners ("Developer'~ of the Project and <br />Cabarrus County, a pohtical subdiws~on of the State of North Carolina, by and <br />through its Cabarrus County Board of Commissioners. <br /> <br />RECITALS: <br /> <br /> A. Developer ~s the owner of approx~ma~:ely 28.79 acres of real property <br />located ~n Cabarrus County, and has proposed the development of a subd~wsion <br />with 92 single family lots in the Moorecrest subdivision pro.lect (the "Project"), to <br />be constructed in multiple phases. <br /> <br /> B. The Project ~s subject to the Adequate Facilities Provisions of the <br />C~barrus County Subdivision Reoulat~ons, Section 66-81, and has been rewewed <br />by all public agencies which may potentially serve the project and ~ts future <br />residents. <br /> <br /> C. Developer is w~lhng to advance pubhc services and facihbes for the <br />Project and to agree to certain other considerations to address Cabarrus County <br />and advance these services and faol~bes. <br /> <br /> D. Cabarrus County, acting pursuant to its authority under G.S. 153A-330 <br />to 335, and the Subdivision Requlabons, has made certain determinations with <br />respect to the proposed Project, and, in the exercise of its legislabve d~scret~on, <br />has elected to process the Project, resulting in the negotiation, consideration and <br />approval of th~s Consent Agreement after all necessary hearings. <br /> <br /> CABARRUS COUNTY AND THE DEVELOPER HEREBY AGREE AS <br />FOLLOWS: <br /> <br />1, The Project <br /> <br />1.1 <br /> <br />Descnotion of Pro_~ect. The Moorecrest Project covered by th~s <br />Consent Agreement presently consists of a s~ngle family lot <br />subdivision located on approximately 28.79 acres. Any chanoes <br />must be in accordance with the Cabarrus County Subdivision <br />Requlations and Zonino Ordinance, and may not to exceed 3.2 <br />umts Der oross acre of the Prooertv.
