Robinson <br />High School and upfit it for use as a field house with appropriation made for <br />purchase of the Pitts School Road Elementary School property. <br /> <br />(E-18) Amended Ordinance Re~ulatln~ the Use of Cabarrus County Parks and <br />Recreation Facilities <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board adopted the following Ordinance. <br /> <br /> Ordin~ce No. 2003-02 <br /> An Ordinance Regulating The Use Of the Cabarrus County, North Carolina <br /> Parks and Recreation Facilities (the "Park" or "Parks") <br /> <br /> W~EREAS making available recreational opportunities for citizens of all <br />ages is a subject of general interest and concern, the Board of Commissioners <br />for the County of Cabarrus, North Carolina (the "County") therefore declares <br />that the public good and general welfare of the citizens of the County <br />require adequate and safe recreational facilities and it is the policy of the <br />County to encourage, foster and provide these facilities for all of its <br />citizens and to preserve and protect the public safety, peace, health, <br />comfort, enjoyment, and welfare of all persons while within the limzts of the <br />Parks. <br /> Be it ordained by the County Board of Commissioners ("Board of <br />Commissioners") that the following Chapter 50-1 through 50-18 of the Code of <br />Ordinances, Cabarrus County, North Carolina supercedes and amends in its <br />entirety Chapter 50-1 through 50-14 of the Code of Ordinances, Cabarrus <br />County, North Carolina, adopted on or about June 17,1991, and the below 50-1 <br />through 50-18 sets forth rules and regulations for the use of and conduct in <br />the County Parks (the "Ordinance") that shall apply to all those who use, <br />visit, or enter the Parks on or after the date of adoption, set forth below. <br /> <br />Section 50-1. Construction. <br /> In the interpretation of this and all succeeding Parks Ordinances, the <br />provisions shall be construed as follows: <br /> 1. Any term in the singular shall include the plural. <br /> 2. Any term in the masculine shall include the feminine and neuter. <br /> 3. Any requirement or prohibitions of any act shall respectively extend <br />to include the causing or procuring, directly or indirectly, of such act. <br /> 4. No provision hereof shall make unlawful any act necessarily performed <br />by any officer or employee of the County Parks and Recreation Department (the <br />"Department") or any other employee or agent of the County or the State of <br />North Carolina (the "State") in line of duty or work, or by any person, his <br />agent or employees, in the proper and necessary execution of the terms of any <br />agreement with the Department, the County or the State. <br /> 5. Any act otherwise prohibited by this Parks Ordinance or any local <br />ordinance shall be permitted if performed within the confines of a properly <br />issued written permit to do so, as set forth herein <br /> 6. This Ordinance is in addition to and supplements the State Vehicle <br />and Traffic Laws, which are incorporated herein and made a part hereof, <br />including without limitation, the requirement that all persons operating any <br />motor vehicle as defined by State law must have a valmd operators l~cense to <br />operate such vehicle within any County Parks. <br /> <br />Section 50-2. Definitions <br /> In the interpretation of this and succeeding Department regulations or <br />ordinances, the following terms unless otherwise defined therein, shall mean <br />the following: <br /> 1. "Department": Cabarrus County Parks and Recreation Department. <br /> 2. ~Foot Path or Trail": Any path or trail maintained for <br />pedestrians. <br /> 3. "Park or Parks": The term Park or Parks shall be deemed to include <br />all aspects of any County Park. <br /> 4. ~Pedestrian": A person on foot. <br /> 5. 'Permit": Any written l~cense issued by or under authority of the <br />Department, permitting the performance of a specified act or acts on Parks <br />property. <br /> 6. "Person": Any natural person, corporation, company, association, <br />joint stock association, joint venture, firm or partnership. <br /> <br /> <br />
