A $CAIV~OiMPANY CONTRIBU~ON IN AID OF CONSTRUCTION AGREEMENT THIS AGREEMENT, made and entered into this 27th day of September ,2002 , between Public Service Company of North Carolina, Incorporated, a South Carolina Corporation d/b/a "PSNC Energy", hereinafter called "PSNC Energy" and Dir(~ctor, Facility ServiCes, Cabarrus County Schools hereinafter, called the "Customer". ~ RECITALS A. The Customer has requeste~d that PSNC Energy install certain facilities for the purpose of furnishing natural gas service to the Customer's pr~mises which are located at 242~Midland Rd. ' Midland, NC 28107 Street.~ldresa City I State Cabarrus _; , and, County B. PSNC Energy has agreed, o~ the terms set forth below, to extend its natural gas facilities from Bethel School Road, Midland, N~ to 2425 Midland Road, Midland NC C. The extension will exceed th~. facilities furnished by PSNC Energy at its expense under Rules and Regulations on file with and approved by the No~h Carolina Utilities Commission, and to that extent will constitute "Excess Facilities." THE PARTIES IN CONSIDERATION OF THE ABOVE RECITALS AGREE AS FOLLOWS: 1. PSNC Energy will install the{natural gas facilities described above in order to furnish natural gas service to the Customer at the Customer,is premises. The Customer will grant PSNC Energy, at no cost, all reasonably necessary utility easements ~r installation and maintenance of the facilities. 2. For all necessary Excess Fadllities, the Customer agrees to pay PSNC Energy the sum of $ 46,936.00 , this amount being due and pa~yable prior to commencement of construction. 3. PSNC Energy will own all suc~ facilities and, regardless of the payment referred to above, the Customer shall have t~o right, title or interest in the fadllities. The Customer agrees this payment is a permanent contribution in aid of construction, to be used by _~SNC Energy for such facilities, and is payable in full of the above regardless of subsequent serv. ice connecti(~ns to any other customers. 4. This Agreement is and shall r~main subject to the rules and regulations and tariffs of PSNC Energy on file with the North Carolina Utilities Comrr~ssion, as modified from time to time, and to any other applicable Commission or governmental requirements.
