7. Interfere with or in any manner hinder any County employee or Park <br />ermployee, the County, the State, or any of their appointed agents in the <br />performance of his duties. <br /> <br />Section 50-13. Enforcement. <br /> 1. Violators of this Ordinance are punishable by immediate suspension <br />from all Parks for not more than thirty days for the first offense. <br />Thereafter, suspenslon may be for such time deemed approximate from time to <br />time by the Board of Commissioners. The Department Director and his designee <br /> (including without limitation, Park officials and County enforcement <br />authorities) are empowered to invoke and enforce this suspension. <br /> 2. Park personnel authorized by the Board of Commissioners and County <br />law enforcement authorities shall have the duty and responsibility to enforce <br />this Ordinance and shall be empowered to issue citations for violations as <br />set forth herein when in their judgment, any provisions have been violated. <br /> 3. In addition to any other State fines and penalties applicable to <br />such citation, each person receiving an Ordinance citation must, within 15 <br />Business Days of its issuance, pay, as a penalty and in full satisfaction of <br />such violation, the sum or sums set forth herein as such fines may be revised <br />from time to time by the Board of Commissioners and incorporated herein. <br />Failure of such person to render payment of said amount within the time frame <br />specified herein may render such person subject to punishment for a <br />misdemeanor under the State General Statutes. <br /> <br />Section 50-14. Ordinance Violations and Fines. <br /> 1. Parking and speeding violations with corresponding fines are listed <br />on the attached Schedule 1, which is incorporated as if more fully set forth <br />herein. Schedule i may be amended from time to time. <br /> 2. Violations of Section 50-5 of this Ordinance, subsections 2, 3, and <br />4 are also punishable by the appropriate penalties and/or laws governing <br />inland waters as set forth by the State Wildlife Resources Commission <br />("wildlife Commission"). Any and all enforcement officers of the Wildlife <br />Commission have full authority to enforce such regulations. <br /> 3. Violations of all other Ordinance sections may also constitute a <br />misdemeanor pursuant to the applicable State General Statutes and may be <br />punishable by additional fines or imprisonment not exceeding 30 days, or <br />both. <br /> <br />Section 50-15. Other Relief Available. <br /> This Ordinance may be enforced by an appropriate remedy as authorized <br /> by the General Statutes of North Carolina. Ail enforcement remedies herein <br /> are cumulative. <br /> <br />Section 50-16. Severability. <br /> If any provision of this Ordinance or its application to any person or <br />circumstances is held invalid, such invalidity shall not affect other <br />provisions or applications of the Ordinance, which can be given effect <br />without the invalid provision or application. <br /> <br />Section 50-17. Effective Date. <br /> This Ordinance supercedes and amends in its entirety Chapter 50-1 <br />through 50-14 of the Code of Ordinances, Cabarrus County, North Carolina, <br />previously adopted on or about June 17~, 1991. <br /> <br />Section 50-18. The Board of Commissioners, in its discretion, may amend this <br />Ordinance in writing from time to time. <br /> <br /> Adopted this the 27=a day of January, 2003. <br /> <br /> /s/ Robert M. Bonds, Clerk <br /> <br />(E-19) Amended Parks Ordinance Violations and Fines <br /> <br /> The proposed Parks Ordinance Violations and Fines were as follows: <br />Parking in Handicapped Area $250.00; Speeding and/or Reckless Driving - <br />$100.00; Parking on Grass $50.00; Parking on Road Shoulder $50.00; <br />Parking in Fire Lane - $100.00; and Other Parking Violations - $S0.00 <br /> <br /> Commissioner Carpenter suggested that the proposed f~nes be reduced by <br />50 percent if paid within fourteen (14) days of the original citation and <br />that the fine for parking in a fire lane be increased to $250.00. <br /> <br /> <br />
