March 17, ~003 <br /> <br />Page 79 <br /> <br /> enacting N.C.G.S~ 105-$17(b) in Section 34.14(a) of Session Law 2001-424, as <br /> · mended by Sessi~ Law 2002-123; and <br /> <br /> WHEREAS, S~ssion Law 2001-424 Section 34.13(a) is repealed July 1, <br />2003, eliminatin~ the one-half percent (1/2%) sales tax that became effective <br />October 16, 2001~ =hereby allowing for the preservation of a combined state <br />and loca! sales a~d use tax of six and one-half percent (6 ~%); and <br /> <br /> WHEREAS, t~e Cabarrus County Board cf Commissioners held the public <br />he·ring on the ~ssue of adopting this resolution on March 17, 2003, as <br />required by N.C.GiS. 105-$17(b) and proper public no=ice of the Board's intent <br />=o consider =his ~resolution was provided as required by N.C.G.S. 105-517(b); <br /> <br /> ~"~EREAS, C~arrus County has lost nearly $4 million in funds made <br />available by the iScate of North Carolina to replace revenue lost because of <br />legislative actio~_~ (1) to repeal sales taxes imposed on purchases made wich <br />Food Stamps; (2~ to repeal property taxes imposed on inventories held by <br />manufacturers, retailers and wholesalers~ (3) to repeal =axes on intangible <br />personal propert~ and (4) to reduce taxes levied on residen~ial <br />owned by low-inco~e elderly taxpayers; and <br /> <br /> WHEREAS, th~ Cabarrus County Board of Commissioners hereby finds that, <br />particularly in t~__ght of the circumstances cited herein, <br />maintain the combined state and local government sales and use tax at six and <br />one-half percent ~(6~%) in order uo adequately finance the operations of the <br />county and the ci~ies and =owns herein. <br /> NOW, THER~£E, BE IT RESOLVED by the Cabarrus County Board of <br />Commissioners <br /> <br /> (1) There ~ is here~y imposed and levied within Cabarrus County =he <br /> third ~one-half percent (1/2%) Local Government Sales ·nd Use Tax <br /> autho~ized by Section 34.14(a) of Session Law 2001-424, as <br /> amend.~6~ by Session Law 2002-123, and codified as Article 44 of <br /> Chapter 105 of the General S~atu=es of North Carolina. The =ax <br /> hereb~imposed and levied shall apply to the same extent and be <br /> subJe?: to the same limitations as are set forth in said Session <br /> Law 2 ~D1-424. <br /> (2) Colle~ion of the tax by the North Carolina Secretary of Revenue, <br /> and l~_bility therefore, shall begin and continue on and after the <br /> first ~ay of July, 2003. <br /> (3) The n.e~ proceeds of the tax levied herein shall be distributed by <br /> the B~cretary of Revenue to Cabarrus County as prescribed by <br /> N.C.G.~. 105-520. The amount distributed to Cabarrus County <br /> shall ~e divided among the county and the municipalities herein <br /> in ac~. rdance with the method by which the one percent (1%) sales <br /> and u~ tax levied in Cabarrus County, pursuant =o Jtr=icle 39 of <br /> Genera_- Statutes Chapter 10S, are distributed. <br /> (4) This l~esolution is effective upon its adoption, and a certified <br /> copy ~reof shall be forwarded to the North Carolina Secret·fy of <br /> Revenue. <br /> <br /> Adopted this~17~ day of March, 2003. <br /> <br /> /s{ Robert M.
