The Nutrition Program Cj~ordinator or a person designated by the Purchaser will <br />examine one meal selectejd at random from meals supplied by the Caterer each day. <br />This examination will include measurement of component weights, as well as visual <br />examination for color an~ appearance and a taste testing for texture, flavor and <br />absence of flavor defectS. In addition, the Purchaser shall have the option of <br />periodically drawing random samples for more detailed analysis by a recognized <br />laboratory and/or may requested documentation from the Caterer testifying to the <br />quality of food products used. <br />The Caterer warrants that ijhe meals delivered under this Agreement will be wholesome <br />and suitable for human conjsumption. The Purchaser shall not be obligated to accept or <br />pay for any food items tha _Jare spoiled, damaged, unwholesome or not delivered in time <br />for serving as specified. <br /> <br />The Caterer shall bill the ~urchaser each calendar month for meals provided. After <br />verification of proper billing the Purchaser shall pay such billing within fifteen (15) days <br />of the receipt of the invoice <br /> <br /> Bills presented to the Pur~aser by the Caterer must include the following information: <br /> 1) a daily accounting of tl~.' number of meals delivered to each site and the original <br /> signed copy of each delivery ticket organized by site and consecutive day;, 2) the total <br /> number of meals deliveredJ 3) the total cost for meals delivered excluding tax; 4) tax <br /> figured on this amount; 5) tie amount of the total billing. <br /> The Caterer shall maintain!full and accurate sales records of purchases and billings <br /> made in connection with tl'{is Program. Caterer will prepare and furnish any and all <br /> reports of other documentalion requested by the Purchaser. All such records, reports <br /> and documentation shall be{.' kept on file for five (5) years after the last date covered by <br /> this agreement. Authorized ~representatives of the Purchaser, North Carolina Division of <br /> Aging and United States Ddl3artment of Health and Human Services shall have access <br /> to all Caterer's records fo~ audit and review at a reasonable time and place with <br /> advance notice to the Caterer. <br />The use of USDA cash res(:{urces at the level instructed by the North Carolina Division <br />of Aging for FY 2004 musi be assured by the Caterer. Detailed records must be <br />maintained on USDA cash Iresources by Caterer. These records must also provide <br />documentation to the Progri~m that the cost per meal includes raw food purchases of <br />U.S. Grown or produced foo~ equivalent to the current USDA rate. <br />Should USDA Commodity/b.~nus foods become available, purchaser will negotiate with <br />Caterer in usir~g foods accoitding to state regulations.
