July 21, 2003 <br /> <br />Page 205 <br /> <br />Development to be .located on the west side of Shiloh Church Road just south <br />of Rocky River. ~he Planning and Zoning Commission unanimously approved =he <br />subdivision on J~lne 19, 2003, with the condition that the Board of <br />Commissioners accept the Consent Agreement. The Planning Board's approval <br />included design a~proval for the 40-10t subdivision on 10.9 acres with a <br />proposed density o~ 3.67 units per acre. The developer has offered $500.00 <br />per lot for adequate public facilities. <br /> There was ~iscussion regarding the proposed subdivision, including <br />design approval b~ the Planning and Zoning Commission, the proposed density <br />and the developer's offer to contribute $500.00 per lot toward school <br />adequacy. CommissiOner Carruth cited concerns about the growth in the county, <br />the lack of funding to build new schools and the continued approval of new <br />subdivisions. Commissioner Carpenter objected to the proposed density and the <br />congestion that currently exists in that area of the county. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs <br />with Commissioner Privette, Vice Chairman Suggs and Chairman Freeman voting <br /> <br />for and COmmlssi~ <br />accepted the Cones] <br />Shiloh Village Sub. <br />Consent Agreement <br />included the paym~ <br />adequacy with payme <br /> <br />(F-S) Consent Agra4 <br />~-.I,.C. <br /> <br />nets Carruth and Carpenter voting against, the Board <br /> Agreement with Shiloh Ridge Development ~.L.C., for the <br />~ivision and authorized the County Manager to execute the <br />on behalf of Cabarrus County. The Planning and Zoning <br /> Commission unanimously approved the subdivision on June 19, 2003, with the <br /> condition that the Board of Commissioners accept the Consent Agreement. The <br /> Planning Board's approval included design approval for the 200-lot <br /> subdivision on 79.,~5 acres with a propose~ density of 2.6 units per acre. <br /> The developer has o!fered $500.00 per lot for adequate public facilities. <br /> <br /> UPON MOTION c.f Commissioner Privette, seconded by Vice Chairman Sugge <br /> with Co~issioners Privette and Carpenter, Vice Chairman Suggs and Chairman <br /> Freeman voting fo~ and Commissioner Carruth voting against, the Board <br /> accepted ~he Consent Agreement with Saturday Investments, L.L.C., for the <br /> Magnolia Springs Su~division and authorized the County Manager to execute the <br /> Agreement on behalfl of Cabarrus County. The Consent Agreement included the <br /> payment of $500.00! per single family lot to advance school adequacy with <br /> payment to be made ~t the issuance of building permitting. <br /> Mr. Robert M~rrison, property owner, again complained of the control <br /> that the City of ~oncord has on water service in Cabarrus County end the <br /> inability to get wa~er service to his property. <br /> (F-T) Consent Agree~nt - N~,~mi11 S,,hd~viaionf L & R Invaa*'~_pn~e L.L.C. <br /> <br /> Vice Chairmanl Sugga asked to be recuaed from consideration of the <br />Hammermill Subdivis~on due to his involvement in the project. <br /> <br /> UPO~ MOT~ON o Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously car:ied, =he Board voted to recuss Vice Chairman Suggs from <br />consideration of the Hammermill Subdivision. <br /> <br /> Mr. Rodger L,~n:z, Planning Manager, presented the proposed Consent <br />Agreement with L & R Investments, L.L.C., for Hammermill Subdivision to be <br />1sca=ed on the east side of Roberts Road Just north of Rocky River. The <br />development is spll: between the Town of Harrisburg and Caberrus County's <br />planning jurisdicti~n with 53 proposed lots in Cabarrus County and 95 <br />proposed lots in the Town's Jurisdiction. The Planning and Zontn9 Commission <br />unanimously approve( that part of the subdivision located in the County's <br />Jurisdiction on June 19, 2003, with the condition that the Board of <br />Commissioners accep': the Consent Agreement. The approval included design <br />approval for the 53-1ot subdivision on 14.94 acres with · proposed density of <br />3.55 unite per acre~ The developer has offered $S00.00 per lot for adequate <br />public facilities. <br /> <br /> C~isaioner ~ivette made a motion, seconded by Chairman Freeman, to <br />accept the ConsentI Agreement with h & R Investments, L.~.C., for the <br />Hammermill Subdivie~on and to authorize ~he County Manager to execute the <br /> <br /> <br />
