August 25, 2003 <br /> <br />Page 233 <br /> <br /> A motion was made Dy Commissioner Privette, seconded by Vice Chairman <br />Suggs to reject the draft UD0 for the County. There was no vote as it was <br />determined that the Board had "tabled" the UD0 ~ntil October 2003. <br /> <br /> U~0N MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board voted to reconsider at ifs next <br />meeting the tabling motion of the Unified Development Ordinance. <br /> <br /> Vice Chairman Suggs expressed concern that the City of Concord is <br />requiring developers of property located Outside the city limits to meet the <br />City's development standards in order for City to provide utilities. He <br />stated this is creating a problem for developers. <br /> <br /> There was discussion regarding the City's enforcement of its <br />development standards outside the city limits, the 1988 Reciprocal Agreement <br />that allows the County to connect to Concord water lines and issues <br />associated with the County,s ability to provide water service. It was noted <br />that the Board had discussed this issue previously but had taken no formal <br />action. <br /> <br /> Mr. Jim Scarbrough, Attorney, advised that he has written several <br />letters to the City on behalf of developers regarding development standards <br />and the provision of water service to developments located outside the city <br />limits. <br /> <br /> D~ON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette <br />and unanimously carried, the Board directed the County Attorney to deliver a <br />letter to the City of Concord describing the County Commissioners, contention <br />that the City Council has no authority to impose its development standards, <br />other than those associated with water and sewer line construction, on <br />projects outside the city limits in exchange for the provision of public <br /> <br />Closed Session <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to go into Closed Session to discuss <br />matters relating to the location or expansion of industries or other <br />businesses in Cabarrus County as authorized by North Carolina General Statute <br /> <br /> ~PON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br /> No action was reported from the Closed Session. <br /> <br /> <br />
