<br />electric power transmission hnes and/or other pubhc utd~hes over ground or underground, and one or more telephone,
<br />cable television, fiber optic or commumcat~ons hne(s) over ground or underground, including the right to erect poles and
<br />other transmission hne structures, w~res, cables, p~pes, and any necessary appurtenances for the proper conduct of
<br />electricity, electromc mformabon, data, commumcabons, water, sewer and other pubhc utd~bes, the right to clear the right
<br />of way and keep ~t clear of brushes, trees, buddings, and fire hazards, and the right to remove trees, if any, located
<br />beyond the hm~ts of the right of way, but which ~nterfere w~th the right of way, the above described rights being ~nc~dent to
<br />performance by the Grantee of ~ts functions as a mumc~pahty or as the operator of any pubhc utd~t~es system, or the
<br />performance by any I~censee of the Grantee of any pubhc utlhhes functions, the premises to be affected hereby being as
<br />follows

<br /> DESCRIPTION OF RIGHT OF'WAY
<br />
<br /> All that certain strip of land situated in Cabarrus County, North Carolina, within the boundaries of or in the wcmity of
<br />north side of M~dland Road, same being twenty feet m w~dth and extending for an approximate length of eight hundred
<br />seventy five (875') feet See attached exhibits A, B, C
<br />
<br /> Together with any and all rights normally inc~dent thereto, and particularly the right of ingress and egress thereto
<br />from time to time as necessary for construction, reconstruction, enlargement and/or maintenance
<br /> To have and to hold the same unto the City of Concord, N C, its successors and assigns forever
<br /> And the Grantor(s) hereby represent(s) that sa~d premises are owned by the undersigned in fee and are not
<br />subject to any mortgage or lien whatsoever, except as follows the holder of such encumbrance(s), by
<br />Joining in the execution hereof, hereby waive(s) m favor of and subordinates to the rights hereby granted
<br />
<br /> This agreement shall not be interpreted to impose any duty on the City of Concord, it's successors and
<br />assigns to install any utilities by any particular date or within any particular time frame.

<br /> The Grantor(s) shall have the right to use the above-described strip for purposes not inconsistent with Grantee's
<br />full enjoyment of the rights hereby granted, prowded that the Grantor(s) shall not erect or construct any building or other
<br />structure thereon, maintain or permit any underground or over ground system of piping, poles or w~nng w~th~n such strip,
<br />make any use of the facilibes installed, buried, erected, or constructed thereon, or drdl or operate any well or septic
<br />system within such strip, w~thout the express written permission of the Grantee
<br />
<br /> The Grantor(s) and Grantee, as ewdenced by their execubon and acceptance hereof, have made the following
<br />special agreement m connecbon herewith

<br />Not withstanding the above, the Grantor shall be entitled to construct, maintain, and repair improvements w~th~n
<br />the Right-of-Way area as per the s~te plans approved by the City of Concord Planmng Department and other City
<br />of Concord authority
