RAFT <br />October 20, 2003 Page~ 261 <br /> <br /> Chairman Freeman requested information for the November meeting as to the <br />estimated cost for making Improvements to the Arena and Events Center to <br />accommodate horse shows. <br /> <br /> UPON SUBSTITUTE MOTION of Commissioner Privette, seconded by Vice Chairman <br />Suggs with Commissioners Privette, Vice Chairman Suggs and Chairman Freeman <br />voting for and Commissioners Carruth and Carpenter voting against, the Board <br />postponed consideration of the proposed increase in the hotel occupancy tax until <br />the regular meeting in Nove~ber. <br /> <br /> There was discussion regarding the continued delay in reaching a decision <br />regarding the proposed increase in the hotel occupancy tax <br /> <br />(F) CONSENT AGENDA <br /> <br /> (F-l) Resolution Authorizing Transfer of Property at 223 Edwards Avenue, Concord, <br /> to Habitat for Humanity <br /> <br /> On April 15, 2002, the Board waived its right of first refusal to acquire <br />property at 223 Edwards Avenue, Concord, thus allowing the Cabarrus County Board <br />of Education to move forward with the sale of the property to Habitat for <br />Humanity at a price of $1.00. The North Carolina General Statutes do not allow <br />the School Board to convey the property by private sale. Therefore, the School <br />Board is giving the property to Cabarrus County for transfer to Habitat. <br />Vocational students in the County school system will participate ~n constructing <br />a house on the property. <br /> <br /> UPON MOTION of Commissioner Prlvette, seconded by Commissioner Carpenter <br />and unanimously carried, the Board adopted the'following Resolution. <br /> <br /> Resolution No 2003-31 <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> RESOLUTION <br /> <br /> WHEREAS, the Cabarrus County School Board (the "School Board") owns a <br />vacant lot in the City of Concord, North Carolina, with a street address of 223 <br />Edwards Avenue (the "Property"), <br /> <br /> WHEREAS, the School Board intends to convey the Property to Cabarrus <br />County; <br /> <br /> WHERE/Lg, the Property is surplus property, has little tax value as a vacant <br />lot and the County has no plans to use the Property; <br /> <br /> WHEREAS, the County is authorized to make appropriations from its budget <br />to Habitat for Humanity Cabarrus County, Inc., a non-profit corporation whose <br />purpose is to wipe out substandard housing in this community (~'Habitat"); <br /> <br /> ~g{EREAS, the County may transfer the property to Habitat by private sale <br />in lieu of an appropriation from the County budget; <br /> <br /> W~EREAS, Habitat wishes to build a home on the lot for one of its deserving <br />families; <br /> <br /> WHEREAS, the School Board and Habitat have agreed that the vocational <br />students in the Cabarrus County school system will participate in the <br />construction of the house to provide the students with a valuable educational <br />opportunity; <br /> <br /> WHEREAS, the County wishes to transfer the Property to Habitat to promote <br />the public purposes of education-and providing affordable decent housing. <br /> <br /> NOW THEREFORE, pursuant to NCGS §161A-279 and §1611%-267, the County Manager <br />is authorized to negotiate and execute all necessary documents to effectuate the <br />transfer of 223 Edwards Avenue, Concord, North Carolina, to Habitat for Humanity <br />Cabarrus County, Inc., to carry out the public purposes set forth hereinabove. <br />The County Manager is further authorized to consummate the transfer of 223 <br />Edwards Avenue, Concord, North Carolina ten (10) days after this resolution has <br />been published in a local newspaper pursuant to NCGS §161A-267. <br /> <br /> This the 20~h day of October, 2003. <br /> <br /> /s/ Robert M.
