WSD - November 17, 2003 <br /> <br />DRAFT <br /> <br />Page 460 <br /> <br />Authority was formed in 1992; and (5) Need to move forward with some kind of <br />agreement on how water and sewer service is to be provided throughout the <br />county. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Pr~vette and unanimously carried, the Board moved to recess the meeting of <br />the Water and Sewer District until the conclusion of the Closed Session to be <br />held by the Board of County Commlssioners <br /> <br /> Chairman Freeman reconvened the meeting of the Water and Sewer District <br />at 9.32 p.m. <br /> <br /> UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette <br />and unanimously carried, the Board adopted the following motion (Resolution) <br />as adopted by the Board of County Commlssioners. <br /> <br /> MOTION TO ASSIGN WATER AND SEWER CONNECTION RIGHTS <br /> <br /> Whereas, on August 15, 1988, Cabarrus County entered into an <br /> agreement with the City of Concord entitled "Reciprocal A&3reement <br /> for Water and Sewer Connections and Related Matters"; and <br /> <br /> Whereas, p~rsuant to the agreement the County has the absolute <br /> right and prlvilege to connect to Concord's Regional water and <br /> sewer system; and <br /> <br /> Several owners of land located outside the city limlts of Concord <br /> desire to connect to Concord's Regiona% water and sewer system; <br /> and <br /> <br /> Whereas, the County desires to assign to those landowners a right <br /> to connect; <br /> <br /> Therefore, the county attorney is directed to prepare standard <br /> assignments wherein the owners and developers and their <br /> successors and assigns of the following parcels of land will be <br /> assigned a r~ght to connect to Concord's water and sewer system <br /> in order to service the developments now proposed for the <br /> following tax parcels and appearing on preliminary plats already <br /> approved by the County Further, no fee will be charged for <br /> these assignments and the Chairman is delegated authority to <br /> execute the assignments on behalf of the County No warranties <br /> shall be provlded in the assignment; and the County shall <br /> contlnue to retain all connection rights under the Reciprocal <br /> Agreement aa fully as if no asslgnment had been made. <br /> <br /> Tax parcel 5538-38-8012 (Brandon Ridge by Craft Homes) <br /> Tax parcel 5538-47-6873 (Brandon Ridge by Craft Homes) <br /> Tax Parcel 5539-52-6448 (Park Place by Craft Homes) <br /> Tax Parcel 5539-62-4526 (Park Place by Craft Homes) <br /> <br /> 5539-31-0300 (Morrison Creek Subdivision by Morrison <br /> <br />Tax parcel <br />Creek LLC) <br /> <br />Tax parcel <br /> <br />Creek LLC) <br /> <br />5539-21-0002 (Morriaon Creek Subdivision by Morrison <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissmoner <br />Privette and unanimously carried, the Board by resolution established the <br />regular meeting schedule of the Water and Sewer Diatrmct to be consistent <br />wlth the regular meetings of the Board of County Commissioners. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Suggs <br />and unanimously carried, the Board voted to adjourn the meeting at 9:34 p.m. <br /> <br />Clerk to the Board <br /> <br /> <br />
