245 DRAFT Revisions to the Expo Con~ract wi~h MaC,hews Cona~ruc~ion Company The Board removed the "Revisions to the Expo Construction Contract" from the Consent Agenda for discussion. Mr. Clifton and Mr. Downs reviewed the proposed "change orders" with Matthews Construction Company for the removal and replacement of unsuitable soils within areas designated for building pads, parking areas and internal streets/driveways. Also, additional site work and storm drainage installation was required as a result of relocating the Exhibit Hall. As agreed to in the original contract, the cost was $10.00 per cubic yard to remove the unsuitable material and $5.00 per cubic yard to replace the soil with compacted fill borrowed from on site. The unsuitable soil was placed at the front of the property along Highway 49 on areas that will be used for overflow parking. Mr. Jon R. Skytta, Soils Engineer with Carolinas Engineering, responded to questions regarding the soil removal/replacement at the Expo site. There was discussion about the type of soil at the Expo site and the cost for removing the unsuitable soil. Commissioner Suggs stated in his opinion the removal cost at $10.00 per cubic yard was "excessive." UPON MOTION of Commissioner Fennel, seconded by Vice Chairman Carruth and unanimously carried, the Board approved the following "Change Orders" with Matthews Construction Company, Inc. According to Mr. Manning's letter, the project will not be built in the foreseeable future. UPON MOTION of Commissioner Fennel, seconded by Commissioner Privette and unanimously carried, the Board authorized a full refund of the WSACC (Water and Sewer Authority of Cabarrus County) Capital Recovery Fee (less 2h percent administrative fees) at $27,857.58 and authorized a full refund of the Building Permit Fee (less 10 percent plan review and other administrative costs) at $23,258.25 for a total refund of $51,115.83 of the $54,414.38 paid to Cabarrus County.
