Insert P: 10.2.$ The Architect will provide ten (10) sets of documents including specifications or other bound material of significant scope under the Basic Compensation fee at any phase of the Pro_iect and at the conclusion of the construction documents phase. Sets of documents necessary_ for coordination between Architect and various consulting engineers will be paid by Architect as part of its Basic Compensation. Additional sets above ten (10) as may be required by authorities having jurisdiction during the submittal and approval process, Owner's review and approval process, or as may be requested by Owner; shall be considered as reimbursable expenses as prevailing rates at the office of the Architect, Invok;:es for same will be charged as provided under Article 10.4. 10.3 PAYMENTS ON ACCOUNT OF BASIC SERVICES 10.3.2 ~Paymcnts for Basic Services shall be made monthly and, where applicable, shall be in proportion to services performed within each phase of service, on the basis set forth in Subparagraph 11.2.2. ~ +~e m=-~er set fe~ ;m S.~b~r=gr:~ ~ ] .~.2. If the ~e ~dally established ~ subpara~aph 11.5.1 is exceeded or extended ~0ugh no hult of ~e Architect, the Architecfs compensation shall be equitably adjusted for ~y additional se~ices reofiired as a result of such t~e berg exceeded or extended. 10.3.4 When compensation is based on a percentage of Construction Cost and any portions of thc Project are deleted or otherwise not constructed, compensation for those portions of the Project shall be payable to the extent services are performed on those portions, in accordance with the schedule set forth in Subparagraph 11.2.2, based on (1) thc lowest bona fide bid or negotiated proposal, or (2) if no such bid or proposal is received, thc most recent preliminary estimate of Construction Cost or detailed estimate of Construction Cost for such portions of the Project. as limited by the "fixed limit" of Construction Cost set forth in paragraph 5.2.2. 10.4 PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES Payments on account of the Architect's Additional Services and for Reimbursable Expenses shall be made monthly upon presentation of the Architect's statement of services rendered or expenses incurred. Insert Q: 10.4.1 The Architect shall present each month a statement of Additional Services rendered and Reimbursable Expenses incurred for the preceding month. The Architect expressly waives any right to payment for any Additional Services rendered if the Architect does not give written notice of its (;laim that the services are additional within 90 days of rendering the services and if such services are not billed as Additional Services within 90 days after the services are rendered. 10.5 PAYMENTS WITHHELD No deductions shall be made from the Architect's compensation on account of penalty, liquidated damages or other sums withheld from payments to contractors, or on account of the cost of changes in the Work other than those for which the Architect has been adj'_'~ged tc be liable is responsible. 10.6 ARCHITECT'S ACCOUNTING RECORDS Records of Reimbursable Expenses and expenses pertaining to Additional Services and services performed on the basis of hourly rates or a multiple of Direct Personnel Expense shall be available to the Owner or the Owner's authorized representative at mutually convenient times.
