During the term of this Agreement, no advertising that promotes any Beverage other than Pepsi products, will be displayed anywhere at or within the Cabarrus Expo Center, except as provided in Section (v) beloW. Pepsi agrees that, if a producer .of an event at the Cabarrus Expo Center has a Beverage sponsor on a national basis, signage of such sponsor may be displayed contiguous to the stage or other performance area during and in connection with such event. Pricing. In consideration of its obligations hereunder, Pepsi agrees to make the following available to the County. Postmix Products. For purposes of this Agreement, the term "Gallons" shall mean gallons of Postmix Products purchased by the County from Pepsi during the Term. Pepsi agrees to make its Postmix products available to the County at its National Account prices in effect on January 31~ of each year under Pepsi's reSPective National Account programs. ("National Account Prices"). These prices will remain in effect throughout each respective year. Packaged Products. For purposes of this Agreement, the term "Cases" shall mean cases of the Packaged Products available from Pepsi at competitive local pricing similar to that offered by Pepsi to similar customers in the same geographic area purchasing similar quantities of Packaged Products, and initially delivered in either quantities of twenty-four (24) 12 ounce size cans and/or twenty-four (24) 20 ounce size plastic bottles, and thereafter in such other size, quantity and type of containers as the parties may, from time to time, mutually agree upon in writing, during the Term. Sponsorship Rights to be Granted. In addition to the Pouring Rights referred to above, the County and/or tenants of the CabTM Expo Center, may grant to Pepsi, subject to the terms and conditions hereof, the rights described in this Section: Log° incorporating sponsor name/logo printed on Cabarrus Expo Center beverage cups distributed at Expo Center concession areas. Pepsi will have the option to purchase One Luxury Suite located in the Cabarrus Arena at the Expo Center. The Luxury Suite includes 15+ seats furnished by the County. All other furniture to be provided by Pepsi including Sponsor Name and Logo recognition. Pepsi shall be required to purchase tickets for all events hosted at the facility that Pepsi is interested in using within Luxury Suites. Notes: Pepsi may also secure, at an additional expense, sponsorship of 'events and teams which host events or games at the Cabarrus Expo Center. Sponsorships may include single-event sponsorships, additional signage, tickets, promotions, broadcast packages, and etceteras. Term. The initial Term of Pouring Rights License described herein shall commence July I, 2002 and shall terminate on June 31~ of the year which is five years after the year during which the first event is held at the Cabarrus Expo Center. Six months prior to the conclusion of the initial Term, the County hereby grants Pepsi the right of first negotiation to exemise a pomfng rights extension or to match any offer made to the County by any other party with respect to the supply of Beverages.
