0311512002 12:22 704-?BB-@058 HARTSELL & WHITE PAGE 20 <br /> <br /> Each party acknowledges that the confidentiality provisions contained in the <br />preceding paragn/ph hereof are required for the reasonable protection of the other party. <br />Each pazty fUrther acknowledges and agrees that a breach of those obligations and <br />agreements may result in irreparable and continuing damage to the' other patty for which <br />there will be no adequate remedy at law and agrees that in the event of any breach of said <br />obligations and ~igreements, the other party and its successors and assigns, shah be <br />entitled to injunctive tel/cf, without the necessity of proving actual damages, and to such <br />other and further., relief as is proper in circumatances. Each party hereby waives any <br />requirement that the Party seeking injunctive relief post a bond of any type. If any of the <br />confidentiality covenants contained in the paragraph proceeding the immediately <br />preceding paragraph, or any portion thereof, shall' be found by a court of competent <br />jurisdiction to be invalid or unenforceable to any extent for any reason, such court shall <br />exercise its discretion to reform such covenant to the end that each party and its affiliates <br />shall be subj.ect~ tO confidentiality covenants that are reasonable under the cia-cumstances <br />and are enforgeable by the other party. <br /> <br /> f) ' I-nd~pendent Contractors. <br />contractors ~o, one another.
