Memo,

From;

cc:

Date:

Cabarrus County Board of Commissioners
Frank Clifton, Manager \~,~,
Jonathan Marshall, Planning Services Director
Fletcher Harlsell, County Attorney
· 04/12/02
Old Airport Road Improvements

The planned improvements to 'Old' Airport Road do not include any additional right-of-way from
adjacent property owners, but they do include the acquisition of a site easement from two owners. A
site easement is an area in which NCDOT requires the removal of trees and shrubs and maintenance
of the area to prevent future growth that may impede sight lines on the roadway. The plans call for a
site easement area of .038 acres from one owner-and .045 acres from another. It appears that one
owner will agree to a purchase of the site easement, but the other owner has not agreed. The amount
that is being offered for these easements is very small since the County will only acquire the right to
remove vegetati,on and maintain that area in grass.

I am requesting that you authorize the County Attorney to proceed with a condemnation process should
we be unsuccessful in obtaining this easement from either of the owners. Construction of the
improvements can 'begin without these easements but they will need to be in place to complete the
construction.

I have attached a map of the overall site with the general area of the site easements and a specific map
taken from the improvement plans that shows more detail.

Page I . ~ -..,
