The Contractor shall take affirmative action <br />to ensure that applicants are employed and that employees are treated during employment <br />without regard to their race, color, religion, sex, age or national origin. <br /> <br /> Section 19. Title VI - Civil Rights Act of 1964. The Contractor will comply with all the <br />requirements imposed bY Title VI of the Civil Rights Act of 1964 (78 Stat. 252), the Regulations <br />of the U. $. Department of Transportation issued thereunder (CFR Title 49, Subtitle A, Part 21) <br />and the assurance by the Contractor pursuant thereto. The aforementioned documents and any <br />subsequent amendments or revisions thereto, are herewith incorporated by reference. <br /> <br /> Section 20. Disadvantaged, Minority and Women Business Enterprises Pm.qram. <br /> <br /> (a) Policy. It is the policy of the Department that any Business Enterprises as defined in <br />49 CFR Part 26 (DBE/MBENVBE) shall have the maximum opportunity to participate in the <br />performance of contrai:ts financed in whole or in part with federal funds under this Agreement. <br />Consequently, the requirements of 49 CFR Part 26, and any subsequent amendments or <br />revisions thereto, apply to this Agreement. <br /> <br /> (b) Obligation under 49 CFR Part 26. <br /> <br /> (1) The Contractor or its contractors agree(s) to ensure that any Business <br /> Enterprises as defined in 49 CFR Part 26 have the maximum opportunity to <br /> participate in the performance of contracts and subcontracts financed in whole or in <br /> part with state funds provided under this Agreement. In this regard the Contractor <br /> or its contractors shall take all necessary and reasonable steps in accordance with <br /> 49 CFR Part 26 to ensure that any Business Enterprises have the maximum <br /> opportunity to compete for and perform contracts. Contractors and their <br /> subcontractors shall not discriminate on the basis of race, color, national origin, or <br /> sex in the award and performance of Department assisted contracts. <br /> <br /> (2) The Contractor shall advise each subrecipient, Contractor, or subcontractor that <br /> failure to carry out the requirements set forth in 49 CFR Part 26 shall constitute a <br /> <br /> <br />
