the Collector shall notify the County of the pending expiration of this Agreement. This <br />Agreement may be renewed for one successive period of five (5) years upon the same <br />terms and conditions then in force upon the written Agreement of the County and <br />Collector. Upon the failure of either party to agree to a renewal within one hundred and <br />twenty (120) days prior to the end of the term this Agreement shall terminate. It is <br />understood by both parties that this provision to renew the Agreement for five (5) years <br />does not constitute an obligation to the County or the Collector for such renewal. <br /> <br />It is understood that unless and until such renewal agreement is in place that landfill <br />space at CMS is not guaranteed beyond the initial five (5) years. <br /> <br />SECTION 5 - STATEMENT OF ASSURANCE <br /> <br />The Collector, for the term of this Agreement, assures the County that said Collector will <br />not on the grounds of race, color, national origin, religion, sex, age, handicap or marital <br />status, discriminate in any form or manner against said Collector's employees or <br />applicants for employment (as provided in Title VI of the 1964 Civil Rights Act, and <br />applicable North Carolina laws understands and agrees that this Agreement is <br />conditioned upon the veracity of this Statement of Assurance. Furthermore, the Collector <br />herein assures the County that said COllector will comply with Title VI of the Civil <br />Rights Act of 1964 when federal grant(s) is/are involved. Other applicable Federal and <br />State laws, Execut. ive Orders, and regulations prohibiting discrimination as hereinabove <br />referenced are included by this reference thereto. This Statement of Assurance shall be <br />interpreted to include Veterans and Disabled Veterans within its protective range of <br />applicability. <br /> <br />SECTION 6 - RESPONSIBILITIlgS OF COLLECTOR <br /> <br />6.1 General <br /> <br />The Collector shall do all the work and furnish, at his own expense, all labor, materials, <br />equipment, and other facilities, as may be necessary and proper for performing and <br />completing the work u.nder this Agreement. <br /> <br />Unless otherwise expressly provided, the means and methods of collection shall be as the <br />Collector may choose, subject, however, to the approval of the County. Only adequate <br />and safe procedures, methods, and equipment shall be used. The Collector shall provide <br />an adequate number of vehicles for regular collection services. All vehicles, containers, <br />and other equipment shall be kept in good repair, appearance, and in a sanitary condition. <br /> <br />6.2 Initiation of Service <br /> <br />A customer shall initiate residential collection service by contacting the Collector. When <br />a customer contacts the Collector to initiate residential service, the Collector shall make a <br />record of the order.. The Collector reserves the right to solicit for the provision of such <br />residential service. <br /> <br />6 <br /> <br /> <br />
