STATE OF NORTH CAROLINA CABARRUS COUNTY INTER JURISDICTIONAL PRETREATMENT AGREEMENT THIS AGREEMENT made and entered into this . day of ,2002, by and between CABARRUS COUNTY, hereinafter referred to as the COUNTY, and the WATER AND SEWER AUTHORITY OF CABARRUS COUNTY, hereinafter referred to as WSACC; WITNESS. ETH: THAT, WHEREAS, these parties have been and in the future may be engaged in providing wastewater treatment services in accordance with state and federal laws and regulations; and WHEREAS, the COUNTY doesn't at this time but may in the future provide and maintain a wastewater collection system, over which the COUNTY will control the use and connections thereto; and WI-W~REAS, WSACC provides and maintains the treatment facilities and is the NPDES 0036269 permittee; and WHEREAS, the COUNTY and WSACC have previously entered into an existing Pretreatment Agreement, which terminates on December 31, 2002; and. WHEREAS, WSACC is identified by the North Carolina Department of Environment and Natural Resources and the United States Environmental Protection Agency as being responsible for the Publicly Owned Treatment Works (POTW); and WltEREAS, WSACC is required by the state and federal regulations to control all non-domestic wastewater discharges into the Rocky River Regional Wastewater Treatment Plant by development and implementation of a pretreatment program; and WHEREAS, the State Department of Environment and Natural Resources is requiring an interjurisdictional pretreatment agreement, with each local jurisdiction served, for the implementation and enforcement of the pretreatment program, by WSACC within the county, in accordance with 40 CFR Section 403 of the Federal Regulations. NOW, THEREFORE WHEN THE COUNTY BECOMES ENGAGED IN PROVIDING WASTEWATER COLIJECTION SERVICES, IT IS MUTUALLY AGREED AS FOLLOWS:
