EXHIBIT A <br />OFFER TO PURCHASE AND CONTRACT <br />CABARRUS COUNTY--BIfYBR <br /> TERESA B. EUDY--SELLER <br /> <br /> This Exhibit A sets forth additional terms and conditions to the Offer to Purchase <br />and Contract between the above referenced p_arties. To the extent the terms of the Offer <br />to Purchase and this Exhibit shall be in conflict the terms of this Exhibit shall control. <br /> <br />Buyer shall pay to seller the sum of $20,000.00 per acre for a non-exclusive <br />forty-five (45) foot right of way for the purpose of egress, ingress, and regress <br />to and from Highway 73 to the property of James E. Patterson (PIN #4681-97- <br />7698), and for the location of all necessary utilities to the Patterson property. <br />The exact acreage being purchased shall be determined by a professibnal land <br />surveyor at the Buyer's expense. The final purchase price shall be determined <br />by multiplying the acreage as determined by the survey by $20,000.00. <br /> <br />Buyer shall determine the location of the righ~ of way. The Seller shall be <br />included in determining the location of the right of way but Buyer shall have <br />the final say. <br /> <br />Buyer shall deposit the sum of $1,000.00 with Hartsell & Wilhams, P.A. as <br />earnest money to be applied towards the purchase price at closing. The <br />remaining purchase price shall be paid at closing by attorneys trust account <br />check. <br /> <br />The Buyer's obligation to purchase under this Offer to Purchase and Contract <br />is conditioned upon the. Buyer being able to purchase a 28 acre, more or less, <br />tract from James E. Patterson, mOre particularly identified as PIN # 4681-97- <br />7698. <br /> <br />This contract is being executed by the agent for Cabarrus County, a body <br />politic, and shall not be binding upon the Buyer until such time as the contract <br />is approved and adopted in open session by the Board of County <br />Commissioners for Cabarms County. <br /> <br />This the __ day of December, 2002. <br /> <br />Buyer: <br />CABARRUS COUNTY <br /> <br />Seller: <br /> <br />By: <br />Name: <br />Title: <br /> <br />Teresa B.
