Ordinance No. 2002- <br /> <br /> ORDINANCE AMENDING CHAPTER 34 <br /> (FIRE PREVENTION AND PROTECTION) <br /> OF THE <br />CABARRUS COUNTY CODE OF ORDINANCES <br /> <br />BE IT ORDAINED by the Cabarrus County Board of Commissioners that Chapter 34, Section 26, 27 <br />and 30, Fire Prevention and Protection, of the Code of Ordinances, Cabarrus County, North <br />Carotina, is hereby amended to read as fo[tows: <br /> <br />ARTICLE I. IN GENERAL <br /> <br />Secs. 34-1--34-25. Reserved. <br /> <br />ARTICLE II. ~-~WAA~LASSISTANCE TO FIRE DEPARTMENTS <br /> <br />Sec. 34-26. ~ Provided to qualified departments. <br /> <br /> The county will cffcr provide financial assistance for the <br />maintenance and operation of any volunteer fire department of a fire <br />district q".'.al i fyin~ <br /> <br />ycar, an~ by revenue collected from the fire district tax, provided a tax <br />district has been established in accordance with G,S. 69-25.1 et seq. for <br />the area served. <br />(Ord. of 12-2-85, § 1; Ord. of 4-3-86, § t; Ord. of 4-7-86, § 1; Ord. of <br />6-17-96) <br /> <br />Sec. 34-27. Participating departments to file budgets with fire marshal. <br /> <br /> A fire department dcsirin~ financial receiving assistance under this <br />article shall file a budget with the fire marshal of the county by April <br />1 each year for the following fiscal year. <br />(Ord. of 12-2-85, § 2; Ord. of 4-3-86, § 2; Ord. of 4-7-86, § 2) <br /> <br />Sec.. 34-30. Minimum standards for qualification. <br /> <br /> Each fire department desiring to qualify for the financial assistance <br />provided for under this article shall meet the following minimum <br />standards: <br /> <br />(1) The fire department shall be incorporated as a nonprofit corporation <br />under state law. A copy of the.department's charter and current bylaws <br />shall be on file in the fire marshal's office. <br /> <br />(2) Elections of at least a portion of the board of directors for the <br />incorporated fire department shall be held at least every year by the <br />voting membership of the corporation.
