Marshall/Planning Services Director <br /> <br />DATE: April 12, 2001 <br /> <br />SUB.1ECT: Rocky Meadows Subdivision <br /> <br />Cc: John Murdock/Water & Sewer Authority of Cabarrus County <br /> Fletcher Hartsell/County Attorney <br /> <br />The Cabarrus County Board of Commissioners approved a 142 lot residential <br />subdivision, Rocky Meadows, on November 15, 1999 under the following <br />conditionS: that the developer Randy Humphrey, Inc., donate 23 acres to <br />Cabarrus County; that the development rights on that 23 acres be transferred to <br />72 acres on the east side of Rocky River Road; and, that approximately $130,000 <br />deposited with the Clerk of Court in the Water and Sewer Authority <br />condemnation proceeding on 13 of the 23 acres be transferred to Cabarrus <br />County in exchange for the 13 acre parcel being deeded to the Water and Sewer <br />Authority. <br /> <br />The Rocky Meadows subdivision is connected to the Midland water line that was <br />constructed through the use of an Economic Development Grant. As part of that <br />grant, the North Carolina Commerce ' and Finance Center requires a re- <br />imbursement policy for any users connecting to the water line other than the <br />intended industries. Randy Humphrey; inc., 'is responsible for $500/Iot <br />connection fee as a result of that requirement. One half of the fee is to be <br />retained by Cabarrus County and one half paid to the State of North Carolina. At <br />complete build-out of the subdivision the fee will be $71,000 total for the 142 <br />lots. <br /> <br />Mr. Humphrey feels that. he should not be responsible for this fee due to his <br />donation of the 23 acre parcel, a portion of which was used for the water line <br />and a booster station that is part of the water line project.. Mr. Humphrey also <br />contends that he was not informed of the fee and considered the property <br /> <br />Planning Services Division <br /> <br /> <br />
