<br />CITY, ils successors and assigns, a perpetual Right-of-way and Easement of no more than iwanty (20') feet in width to go in
<br />and upon GRANTOR'S real property located in No.12 Township, Cabanas County, North Carolina, as more particularly
<br />d~scn'bod in a map by City of Concord, attached hereto and incorporated herein by reference.

<br /> AND TO CONSTRUCT, MAINTAIN AND OPERATE in, upon and through said premises utility line(s) (water,
<br />sewer, or otherwise), with all necessu~, pipes end/or appur~enunees, together with tho fight at all times of ingress, egress and
<br />regmsu thereon, and the right of anuy upon said premises for the purpos~ of inspecting said line(s), making repairs or
<br />alterations thereon, end/or clearing obstructions that may, in the opinion of the CITY, endanger or interfere with the proper
<br />maintenance and operation of the same.
<br /> FUKTHF. R, that the GRANTOR will not impede access to said Right of Way by. the erection of fences, buildings,
<br />ndand plant~rs ,or other improvements that would prevent access of necessary equipment for maintenance or emorgancy
<br />repai~.

<br /> TO HAVE AND TO HOLD the aforesaid Right-of-way end Easement unto the CITY', its successors and assigns
<br />forever;

<br /> AND THE GRANTOR, for GRAN'rOR'S Heirs, successors, personal representatives and assigns, does hereby
<br />covenant with CITY, its successors end assigns, that GRANTOR is seized of the premises in the fee simple, that said
<br />premises arc f~e from all encumbrances, that GRANTOR has good right end lawful authority to sell tho same', end that
<br />GRANTOR will warrant and d~fend the said premises unto the CITY, ils successors and assigns, against the lawfuI clnlr. ~ of
