I have talked with Rich Koch this <br />morning and he informs me that the Town voted to execute the contract last night. I am <br />forwarding the originals to Mr. Koch to have them executed by the Town. In addition, Mr. Koch <br />now has the survey for the property to be conveyed. I will forward a copy and legal description <br />to you prior to the meeting Monday night. I understand that the contract will be placed on the <br />consent agenda for the Commissioners to waive there statutory right of first refusal. The <br />highlights of the contract are as follows: <br /> <br />1. Transfer of.5 acres more or less; <br /> <br /> 2. Land restricted to greenway/natural area, except for necessary utilities as <br />determined by the Town; <br /> <br /> 3. Town will pay $1.00, reimburse and indemnify the Board for any legal expenses <br />or damages involved in the transaction, or any law suits arising from the transaction, and the <br />Town will take over the maintenance of a 30 foot drainage ditch along the border of Stallings <br />Farm to the road. <br /> <br /> 4. Town is restricted from tapping into our sewer system per the terms of the <br />Board's contract with Joe Stallings (the manhole on the border of the school and Stallings is the <br />property of the Town since Stallings dedicated it to the Town when he filed his plat); <br /> <br /> Please let me know if there are any questions regarding this transfer, or if you wish for <br />me to be present at the hearing to answer any questions from the Commissioners. <br /> <br />Si~erely,/'] ,q ~ <br /> <br /> <br />
