Cabarrus County <br />July 11, 2001 <br />Page 3 <br /> <br />County Discretion <br /> <br />Any problems with the Beers bids are the fault of the County and should not have resulted in the <br />rejection of the Beers bids. As shown above, such a rejection violates the General Statutes and the <br />terms of the Solicitation. Moreover, even if the problems described above did not violate the <br />General Statutes and the terms of the Solicitation (which Beers specifically does not concede), the <br />County has discretion to waive bid irregularities. See Para. 5.02 A-C where such discretion is <br />clearly permitted. For the reasons set forth above, the County should exercise its discretion to accept <br />the Beers bids. <br /> <br />Relief Demanded <br /> <br />For the reasons set forth above, Beers demands that its bids be accepted as proper bids under the <br />Solicitation.
