Resolution No. 2001- <br /> <br />RESOLUTION GRANTING COUNTY MANAGER THE AUTHORITY TO <br />NEGOTIATE AND EXECUTE ARCHITECTURAL AND ENGINEERING <br />CONTRACTS WHEN THE ESTIMATED PROFESSIONAL FEES SHALL BE <br />LESS THAN $30,000.00 FOR ANY PROPOSED SINGLE PROJECT IN <br />ACCORDANCE WITH THE "ACT TO PROVIDE A MODEL CODE FOR <br />PROCUREMENT OF ARCHITECTURAL AND ENGINEERING SERVICES <br />BY STATE AND LOCAL GOVERNMENT" <br /> <br />WHEREAS, in 1987 the General Assembly of North Carolina adopted House Bill <br />277 which enacted "AN ACT TO PROVIDE A MODEL CODE FOR <br />PROCUREMENT OF ARCHITECTURAL AND ENGINEERING SERVICES BY <br />STATE AND LOCAL GOVERNMENT"; and <br /> <br />WHEREAS, in said Act it was declared the public policy of this State and all <br />subdivisions and Local Governmental Units thereof, except in cases of special <br />emergency involving the health and safety of the people or their property, to <br />announce all requirements for architectural and engineering services; and <br /> <br />WHEREAS, said Act further states said architectural and engineering services <br />shall be procured from firms qualified to provide such service on the basis of <br />demonstrated competence and qualification for the type of professional services <br />without regard to the fee other than unit price information at this stage; and <br />thereafter to negotiate a contract for architectural or engineering services at a fair <br />and reasonable fee with the best qualified firm; and <br /> <br />WHEREAS, in the event that a contract cannot be negotiated with the best <br />qualified firm, negotiations with the firm shall be terminated and initiated with <br />the next best qualified firm; and <br /> <br />WHEREAS, said Model Code for Procurement of Architectural and Engineering <br />Services provides for an exemption which allows the Board of Commissioners to <br />designate a county official to negotiate and execute contracts when the estimated <br />professional fee shall be in an amount less than $30,000.00; and <br /> <br />WHEREAS, the staff of Cabarrus County has recommended that the Board of <br />Commissioners authorize such exemption and permit the County Manager to <br />negotiate and execute contracts for architectural and engineering services when <br />said project amount is less than $30,000.00; and <br /> <br /> <br />
