Planing and Zoning Commission Minutes <br />_lune 21, 2001 <br /> <br />Page 2 <br /> <br />Mr. Marshall stated to the Board that this subdivision came before <br />the Board a couple of months ago and there was a problem with an <br />adjoining property owner that has been corrected. He said the <br />petitioner is here as well as that adjoining property owner should <br />the Board have any questions. <br /> <br />Mr. Marshall then presented Petition C01-02(S) and staff report <br />stating the Town of Harrisburg is the supplier of water and sewer in <br />this case and they have indicated that they will supply both water <br />and sewer services to this development. He said the restrictions on <br />water remain in effect, which means that they will continue to <br />review new subdivisions and the water systems within them but <br />there is no assurance that they will supply water to that system <br />prior to December 31st. Staff finds that the proposed subdivision <br />meets all the development standards of the County's Subdivision <br />Ordinance. He said staff recommends approval of the LPT <br />Investments, LLC subdivision. :~t is recommended that the Planning <br />Commission grant approval of the subdivision with the following <br />condition. That the developer enters into a consent agreement <br />with the County to met the Adequate Public Facilities Ordinance <br />requirements for school facilities. Mr. Marshall said they have <br />agreed in principle to that but this board cannot approve that <br />consent agreement. The Board of Commissioners needs to <br />approve it. Mr. Marshall said what staff would propose it that the <br />Board actually approve the subdivision as it meets the standards of <br />the ordinance but with the condition that the Commissioners come <br />to agreement with the petitioner on some way to address that <br />inadequacy. <br /> <br />Mr. Drye said the Town of Harrisburg says no new water taps shall <br />be approved until countywide water restrictions are lifted. Mr. Drye <br />said to Mr. Marshall that he said may be restricted. <br /> <br />Mr. Marshall said that is that issue that they will approve plans, <br />they will inspect the construction but they will not allow anyone to <br />tie on to that system until those water restrictions are removed. <br /> <br /> <br />
