5. WHEREAS, the following described real property is presently part of the <br />trust corpus and is subject to the dispositive provisions of the trust: <br /> <br /> Approximately 33 acres of essentially unimproved real estate located at <br />3332 Atando Road, Concord, North Carolina (Pin # 5549-22-1579) <br /> <br /> 6. WHEREAS, the following described personal property is presently part of <br />the trust corpus and is subject to the dispositive provisions of the trust: <br /> <br /> Approximately $22,000.00 in the trust account of Hartsell, Hartsell & <br />White, P.A. <br /> <br /> 7. WHEREAS, Cabarrus County is in need of additional land for public <br />parks and is in need of land that can reasonably be preserved in its natural state. <br /> <br /> 8. WHEREAS, for the foregoing reasons the Cabarrus County Board of <br />Commissioners believes it is in the best interests of the citizens and residents of <br />Cabarrus County that the Board of Commissioners accept the gift of real and personal <br />property from the Elma C. Lomax Living Trust Agreement. <br /> <br /> BE IT RESOLVED, by affn mative vote of the Board of Commissioners on this <br />date, that the gift of the real and personal property described above from the Elma C. <br />Lomax Living Trust is hereby accepted by the Board of Commissioners in behalf of <br />Cabarrus County, pursuant to the conditions and for the purposes contained in that <br />trust agreement. <br /> <br />This 17~ day of September, 2001. <br /> <br />ARNE L.
