Box 707 <br />Concord, NC 28026-0707 <br /> <br />RE: Administrative Office of the Courts' (AOC) Cable Pulls <br /> <br />Dear Mr. Day: <br /> <br />It is my understanding from our conversation on 12/1/00 that the county will not pull the Category 5 <br />cable detailed in an AOC and county attended site survey in early June. These cable runs are required for <br />the installation of a Local Area Network (LAN) in the Cabarrus County Courthouse. Without these cable <br />runs, the AOC will be unable to meet mandated cmmectivity requirements for accessing required <br />applications. <br /> <br />State law requires each county to provide courtrooms and related judicial facilities. A facilities fee is <br />collected in each case filed in the county and remitted back to the county to assist the county in meeting <br />the expenses of providing courtrooms and related judicial facilities. G.S. 7A-302. The facilities fee is to <br />be used by the county exclusively for providing, maintaining and constructing adequate courtroom and <br />related judicial facilities. G.S. 7A-304(a)(2). These include adequate space and £urniture forjm'ors and <br />other court related personnel, and office space, furniture and vaults for the Clerk, judges, prosecutors, <br />and other]udicial staff. Ibid. Although the facilities fee is to assist the county in providing these things, <br />the ultimate responsibility is the county's. State funds, off the other hand, are limited to paying the <br />operating expenses of the Judicial Department. <br /> <br />In determining what comprises judicial facilities, the established custom and usage in this State is that <br />facilities include all the mechanical, electrical and other components of a building that are normally <br />installed by the builder or owner and made available to tenants. These components include such things <br />as plumbing pipes, heating and air-conditioning ducts, and electrical and communications (both voice and <br />data) wires. <br /> <br /> <br />
