Pfivette
306 Cottage Drive
KannapoEs, NC 28083

RE: Cable Access in Courthouse
Dear Coy:

I appreciate your taxing to m~ the County's previous respons~ to Mt. McVey's
letter regarding cable access in the courthouse.

Since re~ivi~ your letter I attempted to contact Mr. McYey, but he was
unavailable. I dM, however, speak tbday with Tony Chung of Aec ooncemiag the
practic~ of other counties across the State relative to this issue. Mr. Chang informed me
that Cabarrus County is the only county ia the State that refuses to pull cable in similar
sittmtbns- He did say, howevex, that s few other eolmtlea have prevlougly rahetl ~n
objection, but that they all had ultimately accepted AOC's position that thc individual
counties were respOns~lc for pul/lng the cable.

I offer the above infommtion only to inform you as to what I hav~ been wld other
counties are do;ng, Of course, just because everyone else apparently views the issue
differently from Cabartus County does not necessarily mean that our county's position is
wrong. Perhaps, it does, however, provide some evidence as to how others have
interpreted th~ relevant statute or statutes.

I do not think it is appropriate for me to offer a legal opinion rcg~rdlng this
matter. I have menfioxm, d thls issue to Fletcher Hsttsell and he, of eom'se, would be in a
position to provide legal advice to you and the other commissioners if requested.
