BOX 244~3 <br /> <br /> RALEIGH, NORTH CAROLINA 27602 <br /> <br />May 10, 1990 <br /> <br />MEMORANDUM <br /> <br />tO: <br /> <br />County Managers and Managers of Municipalities Having Municipal <br /> Seats of Court <br /> <br />FROM: Franklin Freeman, Jr. <br /> <br />SUBJECT: <br /> <br />FACILITIES FEE REVENUE; AUTHORIZED EXPENDITURES <br />FROM FACILITIES FEE FUND; REVISED FORM FOR ANNUAL <br /> REPORTING OF EXPENDITURES <br /> <br /> As you know, the General Statutes of North Carolina provide for collection <br />of a facilities fee by the clerk of superior court in criminal and civil cases before <br />the courts. Such fees are remitted to the counties and to the municipalities which <br />provide the court facilities. These fees produce substantial revenue each year. <br />During 1988-89, approximately $7,800,000 was remitted to the counties and <br />$375,000 was remitted to municipalities by the clerks of superior court throughout <br />the State. <br /> With the reorganization of the court system back in the I960's, the StateN'%~ <br />assumed responsibility for the operating expenses of the courts. Thc counties and <br />the municipalities with seats of court retain the responsibility to provide the~ <br />building facilities and furniture for the courts and for court-related personnel.// <br /> <br /> Since the 1960's, the Administrative Office of the Courts has, under G.S. <br />7A-304(a) (2), shared responsibility with thc counties and municipalities for <br />expenditures from your facilities fee revenue. During these years, this office has <br />annually sent to counties and to municipalities a form for reporting expenditures <br />from your facilities fee revenue. I request your assistance and support in getting <br />these annual reports completed and sent to us. For thc last fiscal >,car (1988-89), <br />we have received this report from most of the counties and most of the <br />municipalities involved. However, there are several counties and municipalities <br />from which we have not received thc annual report. Please review this matter <br />with your finance officer and assure that we have received your report for the <br />1988-89 fiscal year and for any prior years which may still be pending. <br /> <br /> <br />
