The vote was unanimous. <br /> <br />The Vice Chair introduced the second item on the Agenda, Preliminary <br />Subdivision Plat Approval, Petition C01-05(S): <br /> <br />Applicant: Rhein Znterests of Charlotte~ LLC <br />Request: Preliminary Subdivision Plat Approval <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from Rhein Tnterests of Charlotte, LLC to have their <br />subdivision plat Highland Creek Revision approved preliminary. <br /> <br />Mr. Rodger Lentz, Senior Planner, addressed the Board presenting <br />Petition C01-05(S) and staff report stating Highland Creek was <br />approved several years ago. On that zoning approval they asked <br />for 1,134 lots. He said on the replacement map that they have <br />tonight there are 130 additional lots added. This brings the <br />subdivision total to 1,261 lots. <br /> <br />Mr. Lentz said staff finds that the proposed subdivision meets all <br />the development standards of the County's Subdivision Ordinance. <br />The adequate public facilities ordinance requirements should not be <br />considered as they have a vested right to :[,134 lots and a standing <br />agreement with the Board of Commissioners 'regarding the <br />adequate public facilities ordinance requirements. He said Fletcher <br />Hartsell has reviewed the existing consent agreement with <br />Highland Creek and states that the agreement will address the <br />proposed revisions. Mr. Lentz said [here are 130 additional lots not <br />covered by that agreement. This subdivision does meet the <br />standards of the subdivision regulations, the zoning ordinance and <br />those technical standards. He said there are some new lots in this <br />subdivision that would come under the adequate public facilities <br />ordinance. Schools are still inadequate based on the report, so <br />staff recommends denial of this subdivision based on the adequate <br />public facilities ordinance. <br /> <br />Mr. Dwiggins asked Mr. Lentz was he talking about not approving <br />the entire project. <br /> <br /> <br />
