223 <br /> <br />DRAFT <br /> <br /> The Board of Co~unissioners for the County of Cabarrus met in recessed <br />session in the Multipurpose Room at the Cabarrus County Governmental Center <br />in Concord, North Carolina on Monday, November 5, 2001, at 6:30 p.m. <br /> <br />Present - Chairman: Arne L. Fennel. <br /> Vice Chairman: Robert W. Carruth <br /> Commissioners: Robert M. Freeman <br /> Coy C. Privette <br /> Richard D. Suggs <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. <br />Fletcher L. Hartsell, Jr., County Attorney; Mr. John Day, Deputy County <br />Manager for Operations; Mr. Blair D. Bennett, Deputy County Manager for <br />Administration; Mr. Mike Oowns, Development Services Director; Mr. Jonathan <br />Marshall, Planning Services Director¢ Ms. Dawn McHale, Tax Administrator; Mr. <br />Don Cununings, Human Resources Director; and Mrs. Frankie F. Bonds, Clerk to <br />the Board. <br /> <br />Chairman Fennel called the meeting to order at 6:35 p.m. <br /> <br />Courthouse Cabling Pro~ect <br /> <br /> Mr. Gene Morris, Clerk of Superior Court, requested the Board's <br />assistance in replacing the outdated cabling in the Clerk's Office so that <br />the State can install new computer equipment that has already been purchased. <br />There is disagreement between the Administrative Office of the Courts and the <br />County as to whether the State or the County is responsible for paying for <br />new cabling. 'Mr. Morris estimated the cost of new cabling at $15,000.00. <br /> <br /> Mr. Clifton discussed the County's expenses for operating {he courts, <br />including maintenance, utilities, furniture, etc. He reported the State paid <br />to install cabling during the renovation of the third floor of the Courthouse <br />in 1998-99. <br /> <br /> There was discussion as to whether the State or the County should pay <br />for new cabling in the Courthouse. Issues addressed by the Board included <br />the following: (1) facility fee r~venue paid to the County; (2) the County's <br />responsibility to provide and maintain adequate courtroom and related <br />judicial facilities; and (3) varying interpretations of the North Carolina <br />General Statutes concerning expenses paid by State funds. <br /> <br /> UPON ~4OTION of Commissioner Privette, seconded by Co~unission~r Suggs <br />and unanimously carried, the Board directed staff to obtain quotes to install <br />new cabling in the Clerk Of Court's Office and to bring cost estimates to the <br />Board for approval as soon as possible. <br /> <br />Appointment Policy <br /> <br /> A revised Appointment Policy with restrictions concerning County <br />residency was presented to the Board for consideration. The Board had <br />discussed the residency requirement at its meeting on October 22. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Freeman and <br />unanimously carried, the Board adopted the following revised Appointment <br />Policy with the stipulation that those persons who are currently serving on <br />an appointed board or committee and reside outside Cabarrus County may <br />complete their current term of appointment. <br /> <br /> POLICY OF THE <br /> CABAPd{US COUNTY BOARD OF COMMISSIONERS <br />Procedures for Appointments to Boards, Committees and Commissions <br /> <br />A. ELIGIBILITY FOR APPOINTMENTS <br /> <br />(SERVICE ON MULTIPLE BOA/{DS) <br />The general policy of the Board of Commissioners shall be to <br />limit membership of an individual to one official governmental <br />board. The Com~issioners, however, reserve the right to appoint <br />an individual to more than one board under special circumstances. <br />A person serving on one board and receives an appointment to a <br />second board shall automatically be removed from the first board, <br />unless the County Commissioners find evidence cf special <br />circumstances to justify service on two boards. However, the dual <br />membership provision will not apply to the following: (1) <br />appointments to regional/area boards; (2} appointments made of a <br />member of a board in order for that' person to represent that <br /> <br /> <br />
