Box 707 <br />Concord, NC 282064)707 <br /> <br />RE: Concord/Speedway Hotel at Performance Park <br /> Concord, NC <br /> <br />Dear Mr. Clifton: <br /> <br />As requested I am formally requesting to you and the County Commissioners to review a possible refund of <br />our building permit expense for the referenced project. By way of some brief history regarding the project, <br />this was a very tdgh-cnd conference hotel which was to be built at the referenced site next to the Charlotte <br />Motor Speedway. This project has been in the making now for over three years. The ownership of the <br />project has also changed hands on more than one occasion. The closest it came to being built was a little <br />less that a year ago and around the time we applied for, paid for and picked up our building permit for this <br />project. However, the project is now not going to be built in the near foreseeable future, and therefore the <br />building permit will not be used and our expense will have been for nothing. The building permit fee for <br />this project was approximately $60,000.00. We have paid the permit fee to Cabarrus County, but have <br />been unable to be reimbursed for this fee from the Owner group. It appears unlikely we will ever be <br />reimbursed from the Owner group since, once again, the Ownership for the project has changed hands. We <br />are hopeful this project will come back someday, however with the current state of the economy, we are in <br />no position as to even guess as to when that may be. We do know the prospective new Ownership group <br />well and remain hopeful that the project will come back, and will stand ready to build the project if and <br />when that time comes. We also realize that, at that time, the building permit process will have to begin all <br />over again, including fees. <br /> <br />Attached is a copy of all pertinent building permit information including the permit itself. Also attached is <br />a copy of our cancelled check with which we paid for the permit. As you can see the permit was obtained <br />on 3/28/2001. My first contact with Cabarms County after fflooked fairly sure that this project would in <br />fact not be built any time soon, and the prospects for getting built any time in the near future seemed dim, <br />was with Mr. Mike Downs with the Permit's Department. As it turned out the date I had contacted Mr. <br />Downs was shortly after the expiration period for Cabbarms County permits, the time frame for which I <br />was unaware, which was six months. I contacted Mr. Downs approximately late September or early <br />October 2001. Mr. Downs informed me that in fact the permit had expired since it was just past six months <br />after the permit was obtained. Mr. Downs informed me that I could possibly appeal to you, the County <br />Manager and see what other options there may be. I do apologize for taking so much time between when I <br />contacted Mr. Downs and my making contact with you via telephone earlier today, December 5, 2001. <br /> <br />On behalf of Beers Construction I certainly do appreciate your consideration on this matter and your taking <br />it up with the County Commissioners to review the possible refund of the approximate $60,000.00 permit <br />fee which we have expended and have no hope of getting reimbursed.
