He stated the developer had <br />agreed to construct the required turn lanes and any necessary improvements <br />requested by the Department of Transportation. <br /> <br /> There was discussion concerning the following issues: time schedule for <br />the phased development of the subdivision; number of new students to be <br />generated by the subdivision; current and future value of the donated property; <br />and topography of the proposed school site. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Casper and <br />unanimously carried~ the Board approved Petition C99-09(S), the preliminary <br />plat for Canterfield Estates Subdivision, with the condition that adequate turn <br />lanes be constructed along Pharr Mill Road with any additional on and off site <br />improvements as determined by the North Carolina Department of Transportation <br />and that the land be donated in fee simple to Cabarrus County. <br /> <br />Presentation of the Annual Audit for Cabarrus County - Pam Dubols, Assistant <br />Finance Director <br /> <br /> Ms. Pam Dubois, Assistant Finance Director, presented the annual Audit <br />and financial updates for Cabarrus County. She reviewed such items as the <br />major accomplishments for the year, principal taxpayers, general fund revenues, <br />ad valorem tax revenues, sales tax growth, general fund expenditures, school <br />expenditures, outstanding debt, undesignated fund balance and excess fund <br />balance. As of June 30, 1999, the undesignated fund balance was $30,155,982.00 <br />with $14~361,072.00 available for funding priorities and objectives established <br />by the Board. <br /> <br />The Board received the audit presentation as information only. <br /> <br />Presentation Concerning the Proposed Incorporation of Midland and Related <br />Resolution - John Cruanp <br /> <br /> Mr. John Crump reviewed the efforts by Midland residents to seek approval <br />from the North Carolina General Assembly for the incorporation of Midland. He <br />outlined the incorporation procedures as established by the North Carolina <br />General Statutes and requested adoption of a Resolution supporting the rights <br />of the citizens to pursue incorporation. <br /> <br /> Mr. Allen Burnette discussed the proposed boundaries for the new town and <br />population requirements for incorporation. <br /> <br /> Mr. Carl Hill of Midland reviewed population requirements as well as the <br />proposed services to be provided by the town if incorporation is approved. <br /> <br /> Discussion of the proposed incorporation of Midland centered on the <br />following issues: procedures for incorporation; the process that a volunteer <br />committee in Midland has followed in researching and developing a proposed plan <br />for incorporation; opposition by some residents to the proposed incorporation; <br />%he involvement of the Midland Community Association; and the need for <br />additional time to study the incorporation issue. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette with <br />Chairman Fennel and Commissioners Privette and Casper voting for and <br />Commissioners Barnhart and Carpenter voting against, the Board adopted the <br />following Resolution. <br /> Resolution No. 1999-31 <br /> RESOLUTION <br /> <br /> WHEREAS, representatives of the Midland community have informed the <br />Cabarrus County Board of Commissioners that citizens of that community wish <br />to incorporate the Midland area to include those individuals residing within <br />the boundaries as outlined on the attached map; and <br /> WHEREAS, under current North Carolina law, a town may be incorporated <br />only by act of the North Carolina General Assembly subsequent to the review <br />and recommendation by the Joint Legislative Commission on Municipal <br />Incorporations; and <br /> WHEREAS, North Carolina General Statute 120-163 outlines the procedures <br />that a community must follow in its efforts to incorporate~ specifically a <br />petition signed by 15 percent of the registered voters of the area proposed <br />to be incorporated and verified by the Cabarrus County Board of Elections; <br />and <br /> WHEREAS, North Carolina General Statute 120-t63 further requires that <br />the petition must include a proposed name for the city, a map of the city, a <br />list of proposed services to be provided by the proposed municipality, the <br />names of three persons to serve as interim governing board, a proposed <br /> <br /> <br />
