SECTION IX: INDEPENDENT CONTRACTORS <br /> <br />The officers, employees, subcontractors, agents and all personnel of the provider are the <br />officers, employees, subcontractors, and agents of the Provider and are not officers, <br />employees, subcontractors or agents of the County. The Provider is an independent <br />contractor of the County. The Provider further agrees that it and its officers, employees, <br />subcontractors and agents shall obey all state and federal statutes, rules and regulations <br />and are subject to all fund'mg and administrative conditions or hereaf[er applicable to the <br />Criminal Justice Partnership Program. <br /> <br />SECTION X: CONTRACT ADMINISTRATOR <br /> <br />Cabarrus County shall serve as administrator of this contract. The contract administrator <br />shall be responsible for monitoring the Provider's performance; reviewing all invoices <br />submitted by the Provider for treatment services delivered to clients prior to the <br />submission to the County; reviewing all referrals made by the Provider to outside <br />treatment services, and reviewing all outcome data provided by the Provider. Copies of <br />all above data will also be forwarded to Dana Nance, Cabarrus County Division of <br />Community Corrections. <br /> <br />SECTION XI: CONFIDENTIALITY <br /> <br />The Provider shall disclose only to the County and/or Drug Treatment Court, the Contract <br />Administrator, and the NC State Criminal Justice Partnership Program any reproduction, <br />description or information concerning the work produced as a result of this project or task <br />unless written permission is otherwise granted by the County. Further, in connection <br />with the client's records and all information contained therein, including client <br />identifying information, the Provider agrees as follows: <br /> <br />A. That it acknowledges that in receiving, storing process'rog or otherwise using or <br /> dealing with any such information, the Provider and its employees are fully bound <br /> by the provisions of North Carolina General Statutes 122-8.1 as amended and all <br /> other Federal and State Laws and Regulations that govern and guarantee the <br /> treatment fights and confidentiality of individuals receiving substance abuse <br /> treatment services. <br />B. To resist any effort to obtain access to client treatment information not expressly <br /> provided for in the aforementioned paragraph. <br />C. Provider shall obtain appropriately signed forms allowing for the release of <br /> information that may be necessary for the Provider to conform to the requirements <br /> of the NC State Criminal Justice Partnership Program. <br /> <br /> <br />
