425

Join~ Se.si~n with the Plannin~ and Zonin~ Con~ission DRAFY
The following members of the Cabarrus County Planning and Zoning
Commission joined the BOard of Commissioners for discussion: Chairman Ed
Hill and Members Aaron Ritchie, Tom Dwiggins, Stephen Love, Carl Hill, Rusty
Drye, Bill Babb, Carl Hobbs, Dewey Moose and Martha Kiker.

C~airman Fennel stated the purpose of the Joint meeting was to discuss
the relationship between the Board of Commissioners and the Planning and
Zoning Commission. He thanked the Planning and Zoning Commission for the
work that they do for Cabarrus County.

There was lengthy discussion by the County Commissioners, Planning and
Zoning Commissioners and Staff regarding a number of planning and zoning
issues. Discussion centered on adequate public facility issues, including
the following: $500.00 per dwelling unit to address public facility needs
rather than a fee based on a percentage of the value of a new home; the need
for adequate roads and schools in the county; the current process for
addressing adequate public facility issues; the possible transfer of
authority from the County Commissioners to the Planning and Zoning
Commissioners to address adequate public facility issues; the development of
a "consent agreement" related to adequate public facilities to be included in
the approval process by the Planning and Zoning commission and then presented
to the Board of Commissioners for ratification; the development of a check
list that can be used in negotiating adequate public facility issues with
developers; and the possibility of advancing the adequate public facilities
portion of the Draft Unified Development Ordinance for consideration and
adoption.

There was general agreement for Staff to bring forward as soon as
possible a revised Adequate Public Facilities Ordinance for consideration by
the Planning and zoning Commission and the Board of Commissioners.

Chairman Fennel proposed the establishment of an impact fee to be paid
at the time a new house is occupied or sold. Mr. Marshall briefly addressed
legal issues associated with impact fees and the determination of those fees.
After discussion, a majority of County Commissioners and Planning and Zoning
Commissioners indicated by a show of hands their support of pursuing
authority to assess impact fees in Cabarrus County. Staff will prepare a
resolution for the Board's consideration stating the County's desire to have
the North Carolina General Assembly grant Cabarrus County authority to assess
impact fees on new homes.

~J~u~ent

There being no further business to come before the Board, Chairman
Fennel adjourned the meeting at 9:15 p.m.

Clerk to the Board
