<br />Request by the ~ity of Concord for Discretionary Funds

<br /> Mr. Hartsell reported the City of Concord had submitted a request for
<br />discretionary funding through the General Asse~%bly to assist with the
<br />coordination of traffic signals for a portion of Highway 29. In order for him
<br />to proceed with the request, a resolution of support is needed from the
<br />Board.
<br />
<br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Carpenter
<br />and unanimously carried, the Board directed that a resolution be prepared in
<br />support of the request by the City of Concord for discretionary funds to
<br />assist in solving traffic problems on a portion of Highway 29. Further, the
<br />Board authorized Chairman Fennel to sign the resolution on its behalf.
<br />
<br />Plantation Pipeline
<br />
<br /> Mr. Hartsell reviewed recent activities associated with the Plantation
<br />Pipeline right of way near the Coddle Creek Reservoir. The company has
<br />leased an abandoned right of way to Level 3 Communications, a cable provider.
<br />The company is to provide engineering data to the Water and Sewer Authority
<br />prior to beginning any work to be certain the company does not do anything to
<br />impact water quality or safety in that area. Local law enforcement officials
<br />are monitoring the area.

<br /> The following Release of Ail Claims was included in the Reports section
<br />of the Agenda.
<br /> RELEASE OF ALL CLAIMS
<br />
<br /> FOR AND IN CONSIDERATION OF the payment to us of the sum of Two
<br />Thousand Five Hundred Dollars ($2,500,00) and other good and valuable
<br />consideration, we, being of lawful age, have released and discharged, and by
<br />these presents do for ourselves, our heirs, executors, administrators and
<br />assigns, release, acquit and forever discharge Cabarrus County, its agents,
<br />servants, elected officials and employees of and from any and all actions,
<br />causes of action, claims, demands, damages, costs, loss of services,
<br />expenses, compensation and all consequential damage on account of, or in any
<br />way growing out of, any and all known and unknown injury, property damage or
<br />expense resulting or to result from the issuance of the septic tank, zoning
<br />compliance and/or mobile home permits for a structure located upon real
<br />property identified as 2907 Trinity Church Road, Concord, NC (PIN:
<br />5602.03.13.2727), and all building or other inspections associated therewith
<br />and/or any other matter whatsoever from the beginning of time to the date of
<br />this Release.
<br /> We hereby declare and represent that in making this release and
<br />agreement, it is understood and agreed that we rely wholly upon our own
<br />judgment, belief and knowledge of the nature and extent of the circumstances,
<br />and that we have not been influenced to any extent whatever in making this
<br />release by any representations or statements regarding the circumstances or
<br />regarding any other matters, made by the persons, firms or corporations who
<br />are hereby released, or by any person or persons representing him or them, or
<br />otherwise.
<br /> We understand that this settlement is the compromise of a doubtful and
<br />disputed claim, and that the pa}nnent is not to be construed as an admission
<br />of liability on the part of the persons, firms and corporations hereby
<br />released by whom liability is expressly denied.
<br /> This release contains the ENTIRE AGREEMENT between the parties hereto,
<br />and the terms of this release are contractual and not a mere recital.
<br /> We further state that we have carefully read the foregoing release and
<br />know the contents thereof, and we sign the same as our o~a~ free act.

<br />RECESS OF MEETING

<br /> There being no further business to come before the Board, Chairman
<br />Fennel recessed the meeting at 10:12 p.m. until 6:30 p.m. on April 25, 2000,
<br />at which time the Board will meet with the Concord City Council in the
<br />Multipurpose Room at the Governmental Center.
