<br />previous developments to come before the Board. Further, Mr. Marshall stated
<br />the general area of the rezoning is rapidly changing and will continue to
<br />change due to the sewer line currently under construction. The Board has
<br />approved a number of other subdivisions in the area, including Skybrook,
<br />Highland Creek and the Booe-Untz Development. Mr. Marshall reported that the
<br />fiscal impact analysis provided by the Petitioner showed that with the retail
<br />and office base along with the residential housing there would not be a net
<br />loss in terms of tax revenues versus cost of services. In conclusion, Mr.
<br />Marshall stated that staff recommends approval of the rezoning based on all
<br />the listed factors.

<br />Chairman Fennel opened the public hearing on Petition C00-02(R).
<br />
<br /> Mr. Robert Burkett, President of J & B Management and Development,
<br />Inc., reviewed the rezoning request and the amendments to the rezoning
<br />application. The amendments and conditions associated with the proposed
<br />project were set forth in a letter dated June 21, 2000 from Mr. Burkett and
<br />included as a part of the agenda package. Mr. Burkett read & letter from an
<br />Odell Community resident concerning the future of Odell School and then
<br />stated he was withdrawing his proposal to purchase the school property. In
<br />regards to traffic issues, he said he was prepared to implement the proposed
<br />traffic improvements previously submitted to the Board. These included off
<br />site road improvements, signalization, turn lanes, etc. at an approximate
<br />cost of $480,401.00. Mr. Burkett, who is now serving on a traffic committee
<br />for the widening of Highway 73, stated his willingness to take the lead in
<br />the Highway 73 improvement efforts. Also, he committed to paying up to
<br />$50,000.00 for a feasibility study for the Highway 73 widening project. In
<br />regards to the densities, Mr. Burkett stated he was reducing the partial
<br />zoning from High Density Residential to Medium Density Residential. In order
<br />to further reduce the impacts, he proposed to cap the maximum number of
<br />dwelling units to 1,430 at final build-out with phasing to occur as follows:
<br />Residential - 150 new dwelling units in Year 1, 175 in Year 2, 180 in Year 3,
<br />200 in Years 4, 5 and 6, 190 in Year 7, and 135 in Year 8. The totals are to
<br />be cumulative. Further, Mr. Burkett said construction of ~he office complex
<br />would be phased as follows: Zero square feet in Year 1, 60,000 in Years 2, 3
<br />and 4 and 50,000 per year thereafter. This will also involve a cumulative
<br />type plan for building permit issuance. There will be no phasing for the
<br />retail construction. Mr. Burkett summarized the contributions to the County
<br />to satisfy requirements of the Adequate Public Facilities Ordinance as
<br />follows:

<br />In conclusion, Mr. Burkett stated a major concern is the safety of school
<br />children. He reported the bridge on Harris Road over Rocky River is a wooden
<br />structure with a steel girder undercarriage and is 19 feet wide, thus making
<br />it difficult for two school buses to pass on the bridge. However, Mr.
<br />Burkett stated the bridge apparently meets all State warrants.

<br /> Mr. Wayne Ira/in of 7700 Touch Me Not Lane, Concord, stated he had given
<br />the following petition containing 1394 signatures to Commissioner Carpenter:
<br />"ATTENTION: COUNTY COMMISSIONERS - We the under signing request you save
<br />ODELL SCHOOL." He discussed the comments by Mr. Don clickner of the Cabarrus
<br />County Schools at the June 8~h community meeting concerning the usability of
<br />Odell School. Mr. Irvin stated Mr. Clickner had listed 41 problems that are
<br />said to exist at the school, including such things as inadequate water, sewer
<br />and wiring. In response to those problems, Mr. Irvin said a new water main
<br />has been installed in front of the school, a new sewer trunk line is being
<br />constructed along Rocky River and the cost to update the wiring would not be
<br />that expensive. He pointed out the new portion of the school was built in
<br />1990 and that the school has a gym, ballfields and new playground equipment.
<br />Mr. Irvin said in his opinion the facility should be renovated and brought up
<br />to standard. Further, Mr. Ira/in opposed the rezoning which he stated would
<br />allow 500 more units than Mr. Burkett could build under the current zoning.
<br />According to Mr. Irvin, additional commercial activity is not needed in the
<br />community as developments already approved but not completed will add to the
<br />air pollution and create more traffic on already crowded roads in the area.
<br />Mr. Irvin advised that Ms. Sarah LaBelle had stated at the June 8~ meeting
<br />there were no plans for improvements to Highway 73 until 2025. He expressed
