DRAFT The Board of Commissioners for the County of Caberrus met in recessed session in =he Commissioners' Meeting Room at the Cabarrue County ~overnmental Center in Concord, North Carolina, on Tuesday, August 1S, 2000, at 6:30 p.m. Present - Chairman: Arne L. Fennel Vice Chairman: Carolyn B. Carpenter Con~niesioners: Jeffrey L. Barnluart Coy C. Privette Absent - commissioner: Sue B. Casper Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. Fletcher h. Hat, sell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk to the Board. Chairman Fennel called the meeting to order at 6:30 p.m. Approval or Correction of the A~enda U~N MOTION of Comm/ssioner Carpenter, seconded by Commissioner Bax~rt and unanimously carried, the Board approved the ~Jenda as submitted. to Acquire Pro~mrt~ for the Rocky RLver Middle School Site Mr. Clifton reported that condemnation was no longer needed to acquire the property for the Rock~ River Middle School site. He said Mr. John Day, Deputy County Manager for Operations, ar~ Mr. Jonathan Marshall, Planning Services Director, had been successful in. negotiating a suitable solution with the developer. Mr. Day reported the city of Concord vo1%mtarily annexed the Robert Pit=anger property in 1997 and conditionally rezoned the property to allow the construction of 1,200 residential units. As a condition of the rezontng, Mr. Pit=anger agreed to donate 50 acres for a park or school site. in designing a new n~ddle school for the site, architects found that the 50-acre parcel as donated was not conducive to the footprint of the school, ballfleld and parking lot. To resolve this issue, Mr. Pit=anger agreed to sell the County an additional three +/- acres on the northern part of the school site at $20,000.00 per acre. Also, Mr. Pittenger will pay for 600 +/- extra feet of a two-lane road for access on the eastern b~rder of the school, subject to the Department of Transportation and Cabarrns County amending the entrance to the property to be 100 feet fur=her north on Rocky River Road. There was lengthy discussion regarding the Pit=anger property, including the following: {1) tax value of the three acres; (2) the planned access road; (3) the need for turn lanes to the school site; (4) the cooperative efforts by the City of Concord in acquiring the donated property; and (5) the critical time issue for the construction of the new school. Mr. Her=sell pointed out the 1997 donation of land by Robert Pit=anger was the first donation of land in Cabarrus County for a public school site. ge stated there was some question at that time as to whether the Schools wanted the land for a school site. Ms. Cindy Fertenbaugh, cubarrus 'County School Board member, advised that the site work package for the new middle school included an extra $300,000.00 to clear the additional rock found on the mite. Mr. Marshall reported the site plan for the school had been adjusted to avoid the harder rock tb~t would he more ex~ensive to remove. U~ON MOTION of Commissioner Barnhart, seconded by Commissioner Privette and unanimously carried, the Board agreed to purchase the three +/- acres on the northern part of the Rocky River Middle School site from Rocky River Church Road, LLC (Robert Pi=ranger) at a cost cf $20,000.00 an acre and author/zed the appropriate budget amendment. This property will be in addition to the ~O acres donated byMr. Pi=ranger for the school site. He outlined the plans for the new facility that will
